There are two significant problems and the second is generated from the first.
The FIRST problem-
The opinion largely assumes, without actually examining the Constitution itself, that Congress has constitutional authority under Article I to comprehensively regulate pesticide labeling nationwide through FIFRA.
SCOTUS fails in its analysis because the first question should not be whether federal law preempts state law.
The first question is whether the federal government was delegated authority to regulate this subject at all.
The Supremacy Clause declares only laws made “in Pursuance” of the Constitution to be supreme. If Congress exceeds its enumerated powers, its statutes are not supreme over state law.
The Court therefore skipped the most fundamental constitutional inquiry: What specific enumerated power authorizes Congress to control the labeling of products sold within the states?
Without answering that question, the Court treated federal regulatory authority as a given rather than proving it from the Constitution itself.
So what is the REAL SOLUTION…

@KeoweeSCgal It was nationwide. The people exclusively counted their ballots in their local precincts for most of our history. Start training. The elected will protect the system they won their election on.
An update to the prior emergency transmission concerning early voting records in Texas. It just got worse. 49 and 66 days after the vote, the SOS Vendor changed the output format from day-to-day accounting to a cumulative format. Now cumulative format in and of itself is OK - but they forgot to include the day of voting in the data itself. The SOS paved the way for this back in 2025 by writing advisory 2025-17 which absolved counties of having to follow the Texas Election Code requirements. Wouldn't it be nice to have that power? (and let it be noted, the SOS does not)
Point of clarification-
We are NOT celebrating 250 years of “the United States.”
We ARE celebrating 250 years of Independence as sovereign and Independent States.
There is a distinction.
There is a difference.
That distinction and difference matters.
