On Monday, Congress will be voting to advance the KIDS Act, a package of legislation that will mandate all internet platforms to “establish, implement, maintain, and enforce” a suite of limitations on all users that a platform “knows or should have known” is a child. The legislation continues on to outline things it wishes to protect minors from and methods it suggests platforms investigate.
The outcome of this is clear: age verification, AI age assurance, ID uploads, and facial scans. Congress is about to create a de facto requirement on all platforms to know the identity of all their users to such detail that it would stand up to legal scrutiny or risk any random partisan official blocking access to the platform entirely for any reason they deem harmful to minors.
Earlier this week, Pete Buttigieg and his family were the victims of a false CPS report, which saw his family separated for over 24 hours. This was a tragic event, one that the passage of the KIDS Act would make even easier than it already is. The problems of swatting/doxxing are made all the more dangerous when the very information weaponized to perpetrate these attacks is made mandatory for any sufficiently sized website to collect.
There is no prohibition on monetizing any of the collected data that the KIDS Act requires, and as a result, data brokers, AI training centers, and marketing farms will make a new level of personally identifying information available for all to access if you know where to look. The risk of stochastic terrorism, abuse by corporations, and weaponization by state governments that this law will enable far outstrips any of the potential yet to be identified benefits. This bill is a threat to the safety of every internet user.
