TEN REASONS THE LAW REQUIRES THE RELEASE OF ANDREW AND TRISTAN TATE
Today we filed Andrew and Tristan Tate's Motion for Release Pending Extradition in the United States District Court for the Southern District of Florida. Here are ten of the many reasons the law requires their release.
1. Romania heard these same charges and released them. Its courts found Andrew and Tristan were neither a flight risk nor a danger.
2. They complied with every condition of release for three years. The Romanian prosecutor confirmed it in writing.
3. Romania let them travel the world. They visited eleven countries and came back every time.
4. Romania has already ordered their surrender to the U.K. when its case ends. There is no reason why they should be jailed in the USA on England's behalf.
5. These are the same warrants Romania ruled on two years ago. The U.K. accepted that ruling and lived with it. This is forum shopping, plain and simple.
6. There was no urgency. Four days before the arrest, the brothers posted their location publicly: the United States Capitol. The marshals found them at an advertised boxing match.
7. They knew about the charges for years and never ran. Their lawyers engaged the U.K. prosecutors, offered interviews, and sued the Director of Public Prosecutions.
8. They cannot hide. Andrew was the most Googled person on Earth in 2023. Courts released Dog the Bounty Hunter on bond for the same reason.
9. England itself would give them bail. These charges are bailable in the U.K., where the unconvicted enjoy a presumption of release.
10. Their detention is punishment before judgment. Convicted of nothing and charged with nothing in America, they sit in the SHU while the U.K.'s papers are not due until September 16. The Constitution forbids it.

Yet they sit in administrative segregation in the SHU at FDC Miami, and the United Kingdom's extradition papers are not due until September 16. A pretrial detainee may not be punished at all. ANDREW AND TRISTAN TATE ARE BEING DENIED DUE PROCESS.
My clients were arrested on 18 July and placed in solitary confinement. Their bail application is due 5 August. The Government seeks continued detention at a hearing on 13 August.
The United Kingdom has not produced its full extradition package and does not intend to until 16 September.
They are not ready to prove anything, but they are ready to take liberty, imprisoning two American citizens in a cell at American taxpayers' expense.
The process has been weaponized into punishment. Deprivation of liberty before the requesting state has even bothered to produce the complete materials on which extradition supposedly rests. Punishment before conviction is not due process. It is unconscionable.
The United Kingdom says it is trial-ready. Then why is it not ready to submit its request and supporting papers?
