The White House is paving the way for a reauthorization of FISA 702, which they’ll justify by asserting: “The good guys are now in charge of the FBI and NSA, and the abuses have ended, so why give up our terror-fighting tools?”
Remember: FISA 702 is inherently abusive. It provides for the unconstitutional, warrantless surveillance of Americans. It violates the Fourth Amendment in its ordinary usage.
The main problem is not who’s in charge. If a saint were in charge, FISA 702 would still violate our rights. The problem is the program itself.
To stop the abuses, we must stop the program. To stop the program, Congress and the president must not reauthorize it.
