@connor_y123 Police are doing what they can within the limits of state law. Safe T Act made it much more difficult to detain people for trespassing. That would be a nice tool to have for dispersing crowds like this.
I see a few possibilities.
1) Similar to the anti police rhetoric we have heard for years, it frames law enforcement enforcement as the enemy, creating dangerous situations with law enforcement encounters.
2) the ordinance will put admin burden on city staff and our police. They will now be responsible for monitoring and document “ice activity” in Naperville. Use your imagination on how this could be abused by bad actors looking to get Naperville in the news.
3) in Naperville there is very little ICE activity. But that could change, and we might be a target now
4) lastly, the city does get Federal grants. I could do without federal money. But that is also a risk here, losing some federal money.

For now, it should be abundantly clear to anyone paying attention that the last election had consequences, and that activist political pressure is now driving outcomes at City Hall. Pandora’s box is open.
I’ll also add this…symbolic virtue-signaling statements are not without consequence. Elected officials often convince themselves they can pander to activists with purely symbolic gestures and no downstream effects. That is never the case. There are always costs associated with political signaling.
While the ordinance itself may ultimately be legally defensible because, as our legal counsel opined, it is largely symbolic and declarative in nature, its existence will absolutely be used in the future by people looking to create problems for Naperville.

I want to thank DuPage State’s Attorney Bob Berlin for continuing to highlight gaps in the Pretrial Fairness Act.
This case raises a serious issue. A prior domestic violence related offense wasn’t detainable under current law.
It appears the County Board is now taking a closer look.
That’s a step in the right direction. But it’s fair to ask why it takes a tragedy to prompt action when concerns like this have been raised for some time.
After some of our neighboring communities passed similar symbolic ordinances, I was happy that my colleagues resisted the pressure to virtue signal on this issue in Naperville.

Last night, while driving south on Washington through downtown, my family witnessed the “teen takeover” forming near Rosebud that many of you have heard about. I know there’s a video circulating. Seeing it firsthand was unsettling. A squad car was already on site as the crowd began to grow.
We’re still waiting on a full report, but I understand arrests were made related to fights, and several trespassing citations were issued.
This problem isn’t unique to Naperville, but it is a real issue that impacts our businesses, residents, and overall sense of safety downtown. Our police department is working proactively to stay ahead of and deter this behavior, and I appreciate their efforts.
It’s also worth noting that under the Illinois SAFE-T Act, trespassing is generally a non-detainable offense. That limits a tool officers previously had to immediately address situations like this. While this isn’t something I can change at the city level, it does affect how these incidents can be handled in real time and last night is a clear example of that.
