Today I witnessed something deeply disappointing in Hon Mutuku's Chambers.
She has dismissed an advocate's matter for want of prosecution despite the fact that opposing counsel was not even present in court. What was even more concerning was the subsequent remark that she never wanted to be stationed in Nakuru, that Nakuru is a troublesome station and that if the advocate wishea to challenge the directions, they could simply take the court file and change the record.

The wildest part about POVERTY is how much time it steals. Waiting for buses. Calling assistance offices. Comparing grocery prices. Fighting insurance. Sitting at laundromats. Being poor is a second job nobody pays you for.
An Investigating Police Officer is not an eyewitness to the crime. His evidence is admissible when he tells the court what he personally did during the investigation. Once he begins to prove the truth of what others told him after the crime, that evidence may amount to hearsay unless those persons testify. The distinction matters. It can determine whether a conviction stands or falls.
