Thank you, @AmitVUpadhyay for calling out a system where victims and families live under fear and stigma while perpetrators move fearlessly. Deterrence does not come from outrage after a crime. It comes from swift investigation, time-bound trials and certainty of punishment. The law must protect all and must be seen to protect all. Fear must switch sides. Shame must switch sides. From the courts and the police to rehabilitation frameworks and communities, everyone must stand on the side of victims and families.

Nearly a year ago, more than 270 partner NGOs of @JustRightsIndia came together before the #SupremeCourt to challenge a deeply disturbing judgment of the #Allahabad High Court that held that grabbing a child’s breasts and breaking her pyjama string did not amount to attempt to rape. Today, the Supreme Court of India has not only set aside that controversial judgment, but the ruling itself has restored faith in the judiciary to place justice above all else.

Inconsistent interpretations of the law, personal opinion and bias, and at times a lack of responsibility and accountability within the judicial process have often resulted in victim shaming and blaming, and in many cases have forced victims to abandon the pursuit of justice. This judgment marks a critical correction for future generations.

I salute the courage of the mother, the family, and the child, who continue to fight for justice despite relentless odds. They were shunted out of police stations, no FIR was registered, and they had to take loans just to approach the courts. And yet, today, they saw the first beam of justice—with the Supreme Court staying the Allahabad High Court’s judgment. Together, we shall continue this fight. @JustRightsIndia
