Because he knew he had an illegal weapon and had no legal right to use it in a situation where someone wanted to detain him to investigate shoplifting.

But we both know the reason he didn't do that is because he was actively committing a bigger crime than theft so he fled.

If he wasn't a criminal in possesion of an illegal weapon he would have been able to stay and sue.

He was caught committing a crime by being in possession of an illegal firearm and he knew it.
