The CFTC just gave passive crypto asset providers a no-action position.
This means qualifying providers of passive crypto exposure — index funds, ETF-like vehicles, and similar products — won't face enforcement action under existing CFTC rules while the agency builds its formal framework.
A no-action position is not a rule. It's a promise not to prosecute while the rulemaking process continues.
For product providers, it's enough to move forward. Compliance teams can build products knowing enforcement isn't imminent even without a final rule in place.
This is how financial regulation actually works in practice. Formal rules take years. No-action letters allow innovation to proceed in the interim.
The passive crypto fund market is about to expand significantly in the US. Every asset manager that has been waiting for regulatory certainty before launching a crypto index product just got the cover they needed.
Vanguard hiring a Head of Digital Assets suddenly makes more sense against this backdrop.
Bastion just received OCC approval to apply for a national trust bank charter.
Bastion is a stablecoin infrastructure company.
A national trust bank charter for a stablecoin company means one thing: stablecoins issued by Bastion will have the same regulatory standing as those issued by any nationally chartered bank.
This is the GENIUS Act outcome through a different door.
Congress failed to pass stablecoin legislation. The OCC is granting bank-equivalent status to stablecoin issuers through existing chartering authority.
The result is functionally similar. A nationally chartered stablecoin issuer can serve institutional clients who require bank-regulated counterparties.
The pathway to institutional stablecoin adoption just opened without a single congressional vote.
Watch the next six months of OCC stablecoin charter applications. The pipeline will tell you how many stablecoin companies believe this is the better path than waiting for Congress.
The final thread before FOMC week.
Everything I've written about
in the past month comes down
to one question being answered
in three days.
Is the Fed's tightening cycle over?
If yes:
the structural improvements
in crypto over H1 2026
finally have a macro tailwind
to match them.
The gap between fundamental value
and market price closes.
If no:
the structural improvements continue building.
The price discovery waits longer.
Patient capital gets rewarded eventually,
just on a longer timeline.
In either case, the structural improvements
don't reverse.
Goldman doesn't un-buy ETFs.
Vanguard doesn't un-hire its digital asset head.
ETH staking doesn't un-hit its record.
Fannie Mae doesn't un-accept crypto collateral.
The only question is timing.
Not direction.
I've been saying this for months.
Wednesday confirms whether
the timing accelerates or extends.
See you on the other side.
FOMC day.
Decision at 2 PM ET. Press conference at 2:30 PM ET.
Everything we've been tracking for the past two months resolves today.
July jobs: 23,000 losses.
June CPI: -0.4%.
Rate cut probability: 65%.
The data supports a cut. The question is whether the Fed agrees with the data's implication.
Position before 2 PM ET. React after 2:30 PM ET when you have the full context of the press conference.
Today matters. Stay focused.
Let me tell you about the single most important
thing I've learned from studying
every major crypto cycle since 2017.
The investors who win across multiple cycles
don't have superior information.
They have superior emotional management.
In 2018, the information that Bitcoin
would reach $69,000 in 2021
was available in the form of
the halving schedule, adoption metrics,
and monetary policy cycles.
But holding through 2019's grinding recovery
and 2020's COVID crash required
emotional management that most investors
couldn't maintain.
The information was right.
The execution required
something beyond information.
Right now, the information suggests
we're in the late stages of a bear market
with multiple structural improvements
building underneath the surface.
Acting on that information correctly
requires the same emotional management
that every previous cycle demanded.
Not excitement. Not panic.
Patient, systematic positioning
in assets you understand,
sized appropriately for the uncertainty
that still exists.
That's the entire playbook.
Everything else is detail.
I want to address something
that comes up constantly in my replies.
People ask: when is the right time to buy?
Here's the honest answer.
Nobody knows the exact bottom.
Not analysts. Not Cathie Wood. Not Fidelity.
Not Galaxy Research with their 13-point framework.
What we do know is that
the investors who tried to time
the exact bottom in 2018, 2020, and 2022
mostly missed it.
The investors who built positions
systematically over the 6 months
preceding each of those bottoms
captured most of the subsequent gains.
$63,000 might not be the bottom.
$55,000 might not be the bottom.
$42,000 might not be the bottom.
But the investors who are building positions
at $63,000, $55,000, and $42,000
if those levels are reached
will have better average entries
than the ones waiting for
the single confirmed bottom day.
That confirmed bottom day is only visible
in hindsight. Never in real time.
DCA into conviction positions.
Stop trying to time the untimable.
Hyperliquid is trading at $54.74
in a market where everything is struggling.
Let me explain why this matters beyond the price.
HYPE's token economics are structurally different
from virtually every other crypto asset.
97% of all trading fees are used
to buy and burn HYPE tokens.
The protocol doesn't hold fees.
It destroys supply with them.
In August 2026, with crypto markets range-bound
and most assets struggling,
Hyperliquid's trading volume hasn't collapsed
proportionally to its price.
Real volume means real fee generation.
Real fee generation means real buy pressure on HYPE.
This mechanism works in bear markets
as well as bull markets.
Name another crypto asset
where the protocol actively burns supply
using real trading revenue
in a bear market.
I'll wait.
The Strategic Bitcoin Reserve proposal
is still sitting in Congress.
Trump called for it.
Several senators have introduced legislation.
The government is still selling seized Bitcoin
instead of holding it.
The gap between the policy goal
and the actual government behavior
reveals something important
about how US crypto policy actually works.
Presidential support doesn't automatically
translate into changed government behavior.
Agencies have existing mandates
to liquidate seized assets.
Changing that requires specific legislation,
not just executive preference.
If the SBR passes, the US government
goes from being the market's largest seller
of confiscated Bitcoin to being a holder.
That supply dynamic shift would be
one of the most significant structural changes
in Bitcoin's history.
Watch the SBR legislation in September
as carefully as you watch CLARITY and GENIUS.
The June CPI just dropped 0.4%.
That single number moved crypto more than any narrative
has in the past three months.
$BTC jumped 3.8% on the news.
$ETH exploded 6.1% in the same session.
Here is what the market is actually pricing.
Lower CPI means lower odds of a September rate hike.
Lower rate hike odds means the dollar weakens.
Weaker dollar means risk assets benefit.
Bitcoin didn't pump because of a protocol upgrade
or an adoption story. It pumped because of
a government inflation report.
That 85% macro correlation is not going away anytime soon.
But this time the correlation is working in your favor.
$BTC $64,712. $ETH $1,869.
July is becoming interesting.
AI just found a bug in Ethereum that could take validators offline.
The Ethereum Foundation pointed coordinated AI agents at the software validators run and got a remotely triggerable crash as the output.
Here's the part that almost nobody is reporting accurately.
The AI also produced a large number of confident, well-written findings that were not bugs at all. Humans had to verify which findings were real vulnerabilities versus sophisticated-sounding false positives.
This experiment revealed two things simultaneously.
First, AI-assisted security auditing can find critical vulnerabilities faster than human-only review. The validator crash bug would have been extremely difficult to identify through traditional code review alone.
Second, AI produces confident errors at scale. Every false positive that wasn't caught would have wasted significant developer time or, worse, triggered unnecessary protocol changes.
The implications for all smart contract platforms are significant. AI security tooling is now powerful enough to find previously undiscovered critical vulnerabilities in production code. But AI confidence doesn't correlate with AI accuracy.
Any protocol that doesn't deploy AI security auditing is falling behind on defense. Any protocol that deploys it without robust human verification is creating new risks while trying to mitigate old ones.
This is what the frontier of blockchain security actually looks like in 2026.
Bitcoin ETFs just pulled in $265 million in a single day.
BlackRock alone absorbed $209 million.
Last week the same ETFs lost $526 million net.
One day doesn't reverse eight consecutive weeks of outflows. But it breaks the pattern.
Here is what actually matters: institutional money doesn't return randomly. It returns when the risk/reward calculation shifts in their models.
$265 million in one session says some institutional desks recalculated this weekend.
$BTC $63,583. $ETH $1,813. Watch ETF flow data daily this week. It's the only signal that matters right now.
Solana at $81 is pricing in meaningful recovery. The on-chain data says that recovery hasn't arrived yet. The upgrade could change that. Or it could be faster infrastructure for the same speculative cycles.
The honest answer is that nobody knows yet. Anyone telling you otherwise is selling something.
Solana's monthly active users just fell to a two year low of 34.1 million.
Fees are down 50% since January. Total value locked collapsed 56% from the August 2025 peak.
XRP just climbed 8% as its holder loss metrics hit levels never seen before in its history.
The 30-day MVRV is at minus 45%. The 365-day MVRV is at minus 47%.
These numbers mean the average XRP holder across both timeframes is deeply underwater. In every previous cycle, readings at these extremes have preceded significant recoveries.
But here is the context that matters: previous recoveries had a clear catalyst. In 2020 it was liquidity. In 2023 it was Ripple's partial legal win.
Right now the catalyst is supposed to be the CLARITY Act, which just missed its July 4 deadline and sits at 48% passage odds.
Maximum pain in holder metrics without a confirmed catalyst is a setup, not a guarantee.
Five US regulators just jointly proposed bank-grade KYC rules for stablecoin issuers under the GENIUS Act.
Circle's USDC and Tether's USDT are directly in the crosshairs.
This matters far more than another price prediction about Bitcoin, and here is why.
Stablecoins are the plumbing of the entire crypto economy. Every exchange, every DeFi protocol, every institutional on-ramp runs on stablecoins. They're the pipes that connect traditional finance to crypto markets.
Bank-grade KYC requirements would mean stablecoin issuers must know the identity of every user, report suspicious transactions, and comply with the same anti money laundering frameworks that banks use.
For Tether, this is an existential challenge. Tether operates with opacity that would be completely incompatible with bank-grade compliance. Its reserve disclosures have always been questioned. Full KYC compliance would force transparency Tether has resisted for a decade.
For Circle, this could actually be a competitive advantage. Circle has been building toward regulatory compliance deliberately. USDC already operates with more transparency than USDT. Bank-grade rules would widen that gap dramatically.
If USDT faces existential regulatory pressure while USDC becomes the compliant alternative, the stablecoin market could see a shift of hundreds of billions in liquidity within months.
Watch this bill as carefully as you watch the CLARITY Act. The stablecoin regulatory outcome might affect more of crypto's daily functioning than anything else currently in Congress.
Second, the pattern requires the neckline to break with conviction. Bitcoin has swept below key levels multiple times in this cycle, touched $58,188 briefly, then recovered. A wick below the neckline followed by a close above it invalidates the breakdown.
The $55,298 level is binary. Above it, the pattern potentially fails. Below it on a daily close, the $42,000 target becomes the conversation.
This is the most important chart level in crypto right now. Not $60,000. Not $58,000. $55,298.
