Legislative proposals that hold developers liable for their AI tools’ use in creating digital replicas will drive startups away from innovation. The looming threat of costly lawsuits will make it too risky for them to engage in AI development.
Startups want to “chomp” away at creating novel products with AI, but navigating the maze of innovation increasingly involves dodging “ghosts” of poorly-conceived regulation, legal threats, and practical challenges. 🎃🧵
So many points worth emphasizing in this great thread (we all rely on fair use! ruinous damages in copyright law! richard the plumber from this old house!), but this is the big one.
And that's where the logic of "AI is an infringement machine" will lead us. Every creative tool is an infringement machine, in the hands of an infringer. So what? Punishing the tool-makers or forcing them to lock down their tools only hurts creators, and that hurts culture.
This is funny, but it raises important points that merit exploration. Some thoughts on this:
1) Big rights holders are, indeed, suing AI cos. over stuff like this. They don't want to sue it out of existence, though. Their goal is to take a windfall profit by taxing these tools.

The current #dataprivacy landscape doesn't work for startups (or anyone else). As @camilopez points out:
"To solve this problem, Congress needs to pass one uniform federal privacy framework that works for startups."
This is a really good little browser game that shows you the impossible task of being a content moderator on the internet, and how it's never as clear-cut as it seems.
