JUDGE: Why did you take the law into your own hands?

DEFENDANT: My Lord, I did not take the law into my hands. I only recovered items from him because he owed me money.

JUDGE: Recovered items? Who authorized you to do so? And why did you go there with a group of men?

DEFENDANT: My Lord, he borrowed ₦300,000 from me in July last year. Since then, I have repeatedly asked him to repay me. Each time, he would promise “today” or “tomorrow,” but he never paid. Out of frustration, I called some friends and went to his house. I collected his two mobile phones and his motorcycle as security for the debt.

COMPLAINANT: My Lord, as my lawyer earlier stated, my livelihood depends on my phone. All my business contacts and transactions are stored there. I pleaded with him to give me until Monday to pay, but he refused. I eventually raised the money and transferred it to him. However, instead of returning my phone, he claimed it was missing. All my business information was inside that phone. I had no choice but to seek legal redress.

The Court held that even if the complainant owed the defendants ₦300,000, they had no legal right to take the law into their own hands by forcefully going to his house and seizing his property.

Debt recovery must be pursued through lawful judicial process, not iñtimîdatiôñ or self-help.
Since the defendants admitted to confronting the complainant and removing his property without court authorization, the prôsecûtioñ proved its case beyond reasonable doubt.

The Court therefore found them gûîlty and sentenced each of them to three years imprîsónment (to run concurrently), emphasizing that the rule of law must always prevail over personal retaliation.

Having earlier delivered judgment in this matter, the Court now addresses the issue of the seized items namely, the two mobile phones and the motorcycle particularly in view of the fact that the underlying debt of ₦300,000 has since been fully paid by the complainant.

The Court holds as follows:

1.The alleged debt having been liquidated, the Defendants no longer have any claim legal or equitable over the complainant’s property.

2.The seizure of the phones and motorcycle was ûnlàwful ab initio, as it was carried out without judicial authority.

Any continued withholding of the said items after repayment of the debt constitutes wrongful détentioñ and çonversioñ.

Accordingly, this Honourable Court hereby orders:

1.The immediate return of the two mobile phones and the motorcycle to the complainant in good and functional condition.

2.Where any of the items has been lost, dàmàged, or disposed of, the Defendants shall jointly and severally pay full monetary compensation equivalent to their current market value.

3.The Defendants shall further pay reasonable compensation for proven business losses arising from the ûnlàwful détentioñ of the phones, subject to assessment.

The Court reiterates that repayment of a debt does not sanitize an illègál act. Property ûnlawfully taken must be restored, and justice must be complete.
