Exciting, but tiring, day in court (from my study) obtaining an urgent interim injunction restraining a party from cremating the body of the deceased, who died from covid 19, in contravention of the deceased’s testamentary wishes.

The tribunal held that the son validly acquired the home by virtue of a deed of variation of the deceased’s will, but he did not acquire the benefit of the pitch agreement with the park owner pursuant to section 3(3)(b) of the Mobile Homes Act 1983.
In Barrs Residential & Leisure Limited v Pleass Thomson & Co [2020] UKUT 114 (LC) the UT (Lands) considered whether a mobile home remained part of deceased’s estate or passed to his son.
