The Constitutional Court has dismissed uMkhonto Wesizwe’s application for an interdict against the first sitting of Parliament on Friday.

The Court says the case dents engages its exclusive jurisdiction, the MKP misconstrues section 46, and the application was brought late.

The Ngcobo report is the perfect example of Schrödinger’s legal effect. It is both binding until set aside on review and not reviewable because it is preliminary and therefore of no legal effect at the same time.
