In a remarkable Judgement The Supreme Court of India has ruled that a woman is entitled to claim maintenance under Section 125 of the CrPC. from her second husband, even if her first marriage was not legally dissolved.
Justices BV Nagarathna and Satish Chandra Sharma granted relief to the woman allowing her appeal against the Telangana High Court's order to deny her maintenance under Section 125 CrPC. from her second husband just because her marriage with the first husband was not legally dissolved. But what about Section 494 of the IPC which deals with the offense of bigamy, or marrying again while a spouse is still alive? The punishment for this offense is up to seven years in prison and a fine. Seems that section is only for a Man and not a Woman.
