#SupremeCourt REJECTS PIL filed by doctors' organization raising concerns about HPV vaccination for girls

Petitioner- Universal Health Organization: The way in which it is being implemented...there is no adverse event mechanism. Whenever there is adverse event, it has to be monitored. Secondly, there should be compensation scheme. It's being administered to girls of 14-15 years age...there are reports that it impacts their fertility

J Bagchi: WHO prescribes [HPV] vaccine for women. After that, I don't think doctors should come up with a petition. Wherever there's a case of incorrect vaccination, ordinary rules of compensation will apply. No special treatment for adverse impact in case of a particular vaccine

CJI: Don't ask us to make harsh observations. If petitioner members are doctors, it's a very very serious issue. It's a question of health of millions of our daughters. And you want to derail this.

Under the Indian Constitution, the Executive and the Judiciary operate in distinct spheres. A political assurance or executive negotiation made outside the courtroom does not automatically bind or override an independent judicial bench. The Supreme Court adjudicates based on constitutional principles, statutory procedure, and material records before it.

Under criminal jurisprudence (governed by the BNSS / CrPC), law enforcement agencies have a statutory duty to investigate FIRs once registered. The court's direction permitting investigation to proceed is standard judicial procedure to ensure accountability, fair process, and public order.

Attributing political motives to interim directions in pending PILs undermines the integrity of constitutional institutions. The Supreme Court's mandate in public interest litigation is to balance individual rights with public safety and institutional accountability. The court cannot be expected to tailor its orders to informal political negotiations.
