Thailand’s defamation law is not the same as most countries in west and it can be used against the victim or anyone that speaks out.
Let me explain it so you can understand it better.
In the US to sue someone for defamation and winning the case you need to prove that the statement made against you was false and was being purported as a fact.
As we know it has differences from state to state but generally speaking it's mostly handled in civil courts(criminal charges are very rare)
But in both cases your defense is the TRUTH!
If you are stating anything that IS FACTUAL no matter how much it effects the person or corporation's reputation you will not be charged with anything.
Now this is how we mostly think any defamation case should and will be handled buttt in some countries like Korea or Thailand it doesn't really matter if what you're saying is true or not as long as it's hurting someone's reputation!
Let's talk about Thailand now.
The defamation law is not only strict but also(i'm so sorry) stupid.
It does count as a crime and can lead to jail time and deportation for foreigners.
The definition of it is very obvious if you imply anything that harms anyones reputation no matter if it's true or not will get you in trouble!
So the biggest difference is truth is not always a defense!
What does that mean? Well it basically means you can prove the truth of a statement but it doesn't work as a defense if the matter is personal and does not "benefit the public"??
For example if you write a bad review you can end up in jail!!! Yaaaay!!!
Although there are some more sections the law is used to silence ppl and usually celebrities with money can easily put you in jail over a fucking comment if they want to.
