🚨🇧🇷⚖️🗳️ - ALERT TO THE WORLD: The Rule of Law in Brazil is under systematic attack.

Bela Megale’s column in O Globo (July 29, 2026) reveals that Supreme Court (STF) justices are already signaling intervention if the Superior Electoral Court (TSE) fails to punish an AI-generated video of Jair Bolsonaro shown at Flávio Bolsonaro’s convention. They call it a prohibited “deepfake” and fear a “free-for-all.”

But what is at stake goes far beyond a video:

1⃣ Violation of the personality of the penalty — Monocratic and collegiate decisions extend restrictions and punitive effects to third parties (campaigns, parties, supporters, and family members) for acts the convicted person himself did not commit. This violates Article 5, item XLV of the Brazilian Constitution and the universal principle that “no penalty shall pass from the person of the convicted” (International Covenant on Civil and Political Rights – ICCPR, Art. 15; American Convention on Human Rights – ACHR, Arts. 5 and 8; Inter-American Court jurisprudence).

2⃣ Destruction of due process and the natural judge principle — Justice Luiz Fux’s vote in the criminal trial against Bolsonaro exposed the lack of sufficient evidence (Art. 386, VII of the Code of Criminal Procedure), a generic indictment, attribution of responsibility for third-party acts without causal link, and selective oscillation of the STF’s jurisdiction. The Court acts as both judge and party, concentrating power and creating casuistic case law.

3⃣ Lawfare and censorship — The law is being used as a political weapon: prior restrictions on political content, threats of ticket disqualification for the use of AI, and signals that the STF “will step in” if the TSE does not punish.

Furthermore, it must be made clear: the censorship imposed on Jair Bolsonaro and the restrictions on communication/visits with his children are illegal under both Brazilian law and international law.

In Brazil, the Federal Constitution (Art. 5, items IV, IX and XLV) prohibits prior censorship, guarantees freedom of expression, and establishes that no penalty shall pass from the person of the convicted. Broad restrictions that ban the use of social media — including by third parties — and turn any indirect statement into a risk of imprisonment constitute prior censorship, forbidden since 1988 and reaffirmed by the STF’s own jurisprudence (ADPF 130).

The suspension of visits by his children (such as the 90-day ban imposed on Flávio Bolsonaro) approaches incommunicado detention, a measure the Brazilian legal system has considered unconstitutional since the 1988 Constitution. A detainee has the right to family assistance (Art. 5, item LXIII of the Constitution). Restrictions must be proportional and based on concrete risk — not used as an additional sanction or a tool of political silencing.

Internationally, these measures violate:
➡️ ACHR Arts. 8 and 13 (judicial guarantees, right to communicate with family members, and prohibition of prior censorship);
➡️ ICCPR Arts. 10 and 19 (humane treatment of persons deprived of liberty and freedom of expression);
➡️ Jurisprudence of the Inter-American Court of Human Rights, which has repeatedly condemned arbitrary restrictions on family communication and the use of the law as an instrument of political persecution (lawfare).

Fundamental guarantees, human rights, and due process of law are being crushed. What is happening in Brazil is not an electoral dispute: it is the normalization of the selective use of the judicial apparatus to persecute, isolate, and silence.

We urgently call for the attention of the Inter-American Commission on Human Rights, the UN Human Rights Council, democratic parliaments, and the international legal community.

The world must look. Silence is complicity.

The $240,000 Lightfish vessel, built by California company Seasats, closed to within visual range of the warship about 105 km northwest of Luzon.
