And also has agreed with Ripple defense for SEC documents and emails to be produced. Ripple have good lawyers in fact one who worked for the SEC he understands security laws. Good so far.

They have very good lawyers some previously working for the SEC. Not a bad sounding defence, given the long wait for clarity, other goverment agencys ruling them a currency and so on.
