If the case involving the volleyball player presented by Heinecke's legal team is considered comparable in Judge Balkman's opinion, then I'd say Heinecke is a comfortable favorite.
@BarristeredOK Could be many reasons. They were building a case. They weren't sure if they were going to do it. They wanted to delay as long as possible so the potential appeals process ran longer through the season, which would render the case moot. Very interesting.

I figured legal action was unlikely due to several reasons laid out in this thread.
However, Heinecke probably decided to go for it to potentially give himself an extra option if he doesn't make a NFL roster.
From what I can tell, Heinecke's legal path would be to get a sympathetic judge who was open to the argument that the NCAA redshirt rule, which has different guidelines for football, is unfair to athletes who play other NCAA sports.🧵

NEWS: Oklahoma Atheltic Director Roger Denny tells ESPN that Porter Moser will return to the Sooners next year. They met this morning and spoke about building the program for 2026-27, including increased resources throughout the program and specifically NIL for players.

"Candidly, we're not resourced at the level that we need to be resourced," Denny told me.
"I'll never be someone who will hold someone to account for performing above the resource level."
In summary, Heinecke is unlikely to take legal action. He has a longshot case, and, more importantly, he doesn't have the time.
However, if Heinecke does not get drafted or signed as an UDFA, then he may as well go for it. He'd have nothing to lose. (except legal fees)
