MANILA, Philippines (AP) — A magnitude 7.8 earthquake shook part of the southern Philippines early Monday, and a tsunami was possible on some regional coasts.

Power outages were reported and people were urged to go to higher ground. No further information on damage or casualties was immediately available.

The epicenter was 13 kilometers (8 miles) southwest of General Santos city on the island of Mindanao and had a depth of 10 kilometers (6.2 miles), according to the Philippine Institute of Volcanology and Seismology. It struck at 7:37 a.m.

The Pacific Tsunami Warning Center said tsunami waves up to 3 meters (10 feet) were possible on some coasts of the Philippines. Waves up to 1 meter (3 feet) were possible on some coasts of Indonesia and Malaysia.

"We advise people to evacuate to higher grounds or go further inland," Teresito Bacolcol, the head of the Philippine institute, warned people living in coastal areas.

Smaller tsunami waves were possible in Taiwan, Japan, Guam, Papua New Guinea and several island nations and territories in the western Pacific.

Residents felt the earthquake tremors in Indonesia's North Sulawesi and North Maluku provinces.

The Philippines, one of the world's most disaster-prone countries, is often hit by earthquakes and volcanic eruptions due to its location on the Pacific "Ring of Fire," an arc of seismic faults around the ocean. The archipelago is also lashed by about 20 typhoons and tropical storms each year.

This is a formal request under the Tennessee Public Records Act (T.C.A. § 10-7-503 et seq.) for all records related to Dalton Levi Eatherly, currently detained at the Montgomery County Jail.

Specifically, please provide:
1. Copies of all eight (8) grievances filed by Mr. Eatherly concerning denial of access to a physical Bible.
2. All responses to those grievances from jail staff, including Captain Jessica Oakes or any other administrators.
3. Any related internal memos, emails, notes, or documentation addressing his requests for a physical Bible, religious accommodations, or the use of a tablet as a substitute.
4. Any policies or procedures regarding religious materials, physical books vs. electronic tablets, and differential treatment of religious practices (e.g., physical Torah vs. Bible).

Please produce these records as soon as possible and no later than the time required by Tennessee law. If any fees will be charged, please provide an itemized estimate in advance.

In addition to this records request, please be advised of the following:

Mr. Eatherly has been denied a physical Bible after it was confiscated during a cell transfer following three weeks in solitary confinement. He was provided only a malfunctioning tablet that crashes frequently, cannot be adequately charged during the day, and makes navigating a PDF Bible of thousands of pages effectively unusable. He has politely requested a physical replacement—even offering to pay—and has filed at least eight grievances, all of which were denied with the position that the tablet is “sufficient.”

This denial constitutes a clear violation of his rights under:
- The **First Amendment** Free Exercise Clause
- The **Fourteenth Amendment** Equal Protection Clause (particularly given the allowance of a physical Torah to a neighboring inmate while denying the same to Mr. Eatherly)
- The **Religious Land Use and Institutionalized Persons Act (RLUIPA)**, 42 U.S.C. § 2000cc-1, which imposes a strict scrutiny standard on burdens to religious exercise in correctional facilities

The jail’s actions represent arbitrary and capricious interference with sincere religious practice, unequal treatment between faiths, and retaliation for protected requests.

**The Institute for Reactionary Reform**, along with other allied organizations and counsel, intends to join or support a civil rights lawsuit under **42 U.S.C. § 1983** against the Montgomery County Sheriff’s Office, the Jail, Captain Jessica Oakes, and other responsible officials for these ongoing constitutional violations. We are documenting all communications and grievances for use in that litigation.

We strongly urge you to immediately remedy this violation by providing Mr. Eatherly with a physical Bible (or allowing him to purchase one) and preserving all related records.
