Solidarity: Government trying to hijack rugby
Solidarity condemns the announcement by Minister Parks Tau to declare the upcoming Rugby’s Greatest Rivalry 2026 Tour a protected event. This decision is a blatant abuse of power that opens the door to greater state control over private sporting events. It also increases costs and limits organisers’ freedom of choice.
Solidarity’s legal team is already submitting comments on the proposed regulations and will oppose the measures on all available legal grounds.
According to Theuns du Buisson, economic researcher at the Solidarity Research Institute (SRI), the government should not use this opportunity to impose controversial procurement requirements on private organisations.
“Our biggest concern is the attempt to impose BEE regulations and procurement requirements on the organisers of the All Black tour. Solidarity is already challenging the Public Procurement Act in court. Imposing these requirements on independent events while the Act is still being challenged makes no sense,” says Du Buisson.
According to Du Buisson, the decision amounts to the state being able to hijack a rugby tour for its own personal gain.
“Where does this decision leave businesses that have already signed contracts for supporter jerseys, marketing and other products? If the law is applied to its fullest extent, only 100% black-owned businesses may have the right to manufacture or sell Springbok supporter jerseys. Such an outcome is simply absurd.”
Solidarity also warns against the dangerous precedent this creates.
“Once a minister can declare anything to be in the ‘public interest’ and subsequently subject it to state procurement requirements, there is virtually no limit to state interference. Today it is rugby. Tomorrow the same principle could be applied to many other private events.”
Du Buisson further points out that the proposed requirements impose additional administrative burdens and costs on organisers.
“Mandatory impact reports to the minister and other regulatory requirements increase the cost of hosting major events. South Africa should encourage international sporting and cultural events, not deter them through excessive state control.”
Solidarity will continue to oppose these regulations and defend the principle that private events should not be hijacked by the state for political or ideological purposes. Our court case against the Public Procurement Act continues in the Constitutional Court.
