This morning at the Trial Lawyer’s Summit in Miami, Mike Papantonio delivered a no-nonsense reminder of what it actually means to be a trial lawyer. It’s about being bold and taking risks, because “playing small has never changed the world,” he told a room packed with attorneys.
Mike’s message was clear: Real justice doesn’t happen with one isolated case. “Take one case at a time, but be involved with thousands of cases," he urged. "That’s when you’re changing systems.”
Using PFAS as an example, Mike also laid bare how corporate harm stays hidden. “This product is in your body right now. Everybody in this room has it. Some of you have levels that will cause cancer,” he said. “Yet the public didn’t hear about it for decades. Why? Because of advertising dollars. Same reason you don’t hear about bad effects from pharmaceuticals.”
Mike said that silence was broken only after trials exposed the truth, long before a movie like Dark Waters ever reached the screen.
On strategy, Mike broke down the deposition approach that has defined his career: “Attack. Attack. Attack.”
“You start with a document, you develop your theme around the document, and then you beat them to death with it,” he said plainly. “A depo is not the time to be warm and fuzzy.”
Mike pointed to the opioid litigation as proof that illustrating and naming the truth matters. Specifically, he talked about data from the EPA documenting deaths resulting from the opioid epidemic. Rather than just talk about numbers, Mike said he showcased the data on a map of the U.S., and he gave that map a name: the “death map.”
“The EPA didn’t call it the damn death map, but I did. And all of a sudden, that ‘death map’ plagued the opioid industry for two years. Because everybody should have known.”
Mike closed by encouraging lawyers to step outside the grind of everyday work and into cases that actually change systems. “There’s room for everybody in this room,” he said. “Do something that’s different. That’s how you change the culture.”
