This is exactly where Parliament has failed Kenyans. It has allowed a digital lending ecosystem where interest, fees and penalties can become punitive enough to turn a small mistake into financial ruin.

BIG WIN for my client as the Court has quashed a loan carrying an interest rate of over 469%! The client mistakenly borrowed Kshs. 85,080 instead of Kshs. 8,000, notified the lender immediately and refunded the entire principal within 24 hours. Despite this, he was pursued for Kshs. 75,694 in interest and penalties.

The Court found the charges excessive and unconscionable. The lender was seeking Kshs. 66,578 in interest on Kshs. 85,080 in just about two months, translating to approximately 39.1% per month and over 469% annually, excluding a further Kshs. 9,116 in penalties. The Court described the charges as punitive, oppressive and disproportionate.

The Court has now declared the Kshs. 75,694 demand unlawful and unenforceable, ordered the loan account CLOSED with a NIL balance and dismissed the lender’s counterclaim. The judgment is a strong reminder that contractual terms will not automatically be enforced where they produce unjust, oppressive or unconscionable outcomes.
