Very important consumer credit decision today; Smith v RBS; Supreme Court overturns decision of Court of Appeal on issue of limitation in consumer credit claims. SC decided that limitation period starts when credit relationship ends extending period possibly by many years.

Judgment in SC on Philipp v Barclays. Appeal allowed: Quincecare obligations restricted to APPs by agent and not the victim. Closes the doors for victims opened by the Court of Appeal.
Tomorrow decision of Supreme Court in Phillip v Barclays Bank [2023] UKSC 25 push pull fraud claim. Will determine many elements of banks liability for frauds in which payments are made by innocent victims from bank accounts. Will SC agree with wider reading of liability by CA?
