[BREAKING] Court Suggests Ending Lawsuit Against #KimSoohyun as Eider Dramatically Reduces Claim

On July 8, the second hearing was held at the Seoul Central District Court’s 45th Civil Division for the damages lawsuit filed by outdoor brand Eider against Kim Soohyun and his agency, Gold Medalist. Earlier, after suspicions were raised that Kim Soohyun, who had been chosen as the brand’s advertising model last year, had dated the late Kim Saeron when she was a minor, Eider claimed its brand image had been damaged and filed a damages lawsuit in August last year.

At the hearing, Eider withdrew its original damages claim based on the social controversy and reduced the amount it was seeking from about 2.5 billion won to about 400 million won. It said it would now only seek the return of the remaining model fee under the advertising model contract.

However, the court said it appeared Eider had changed the purpose of its claim because it believed its original damages claim would be difficult to have recognized. The court also expressed the view that, “If that is the case, it is questionable whether the revised claim can also be legally recognized.”

The court believed that, in this case, both Eider and the defendants, Kim Soohyun and his agency, were victims of the allegations raised by Kim Seui. It also took into account that Kim Soohyun’s side is in discussions with other advertisers and recommended that Eider consider ending the dispute by withdrawing the lawsuit while keeping the advertising model contract in place, with each side paying its own legal costs.

This hearing is drawing attention because it is the first case since Kim Seui’s detention in which an advertiser withdrew its large damages claim against Kim Soohyun and his agency, seeking only the return of the remaining model fee under the contract. People are watching to see whether this will affect other lawsuits currently being pursued by advertisers.

Meanwhile, the third hearing for Eider’s damages lawsuit against Kim Soohyun and his agency will be held on August 26.

[ENG] JTBC Newsroom: Prosecution Found Audio Used to Accuse #KimSoohyun Shows Signs of Manipulation

Recently, Kim Seui, the head of Garo Sero Institute who was recently arrested and indicted, has insisted that the voice of the late actress Kim Saeron, in which she says she dated actor Kim Soohyun when she was a minor, was not manipulated.

But from JTBC reporting, we found that the Supreme Prosecutors’ Office Forensic Science Division concluded that there were signs it had been manipulated.

After even analyzing the frequency bands of the audio file, they found signs that it had been pieced together.

In May last year, Kim Seui, the head of Garo Sero Institute, released an audio file, saying it was a conversation the late actress Kim Saeron had with someone she knew.

“Yes, I dated Soohyun oppa.”

“You might think I’m crazy and not believe me, but we started dating when I was in middle school, and we broke up after I went to college.”

“Middle school?”

“Yes.”

Kim Soohyun’s side claimed it was a manipulated audio file, but Kim Seui denied it until the very end.

“The private company hired by Kim Soohyun’s side said it was AI manipulation.”

“Are you saying you’re going to believe the private company hired by Kim Soohyun’s side?”

After taking over the case, the prosecution analyzed the audio file again through a security investigation. The Supreme Prosecutors’ Office Forensic Science Division handled it directly.

The prosecution found interruptions in the voice signal and that the frequency bands of the male and female voices were different.

They concluded that it was possible the woman’s voice had been played back from another device and then recorded again.

In other words, the man claiming to be the informant allegedly played a manipulated voice of Kim Saeron that he had made separately, then re-recorded it to make it sound like they were having a conversation.

Procedures are also underway to recover all the profits Kim Seui earned through this alleged manipulation. The Crime Proceeds Recovery Division of the Seoul Central District Prosecutors’ Office is tracking down all of Kim Seui’s donation accounts and examining them closely.

Since there are so many victims of Garo Sero Institute and so many different cases are involved, it is reported that the process of recovering the criminal proceeds is quite complicated.

Jeong Seongho, South Korea’s Minister of Justice, said they will stop cyber wrecker crimes by thoroughly recovering criminal proceeds and leaving not even a single won behind.

Meanwhile, Kim Seui, who was also indicted on charges of stalking and threatening YouTuber Tzuyang, did not appear for his first trial yesterday. The court gave a strong warning, saying it could issue a warrant to bring him to court.

즉, 제보자는 한쪽에는 '미성년자 시절 교제', 다른 쪽에는 '성인 이후 교제' 등 입맛에 맞게 조작한 최소 4가지 버전의 AI 녹음 파일을 만들어 유튜버들과 기획사를 상대로 '폭로 비즈니스'를 벌인 것이다.

Kim Seui, the head of the YouTube channel Garosero Institute, had an arrest warrant requested against him on charges including defaming actor Kim Soohyun in connection with the late actress Kim Saeron’s death. He strongly denied all charges, calling the arrest warrant itself a complete fraud.

“The arrest warrant request is clearly packed with outright false facts. I admit nothing. This is an intentional and hastily thrown-together arrest warrant request.”

The police concluded that Kim Seui’s conduct was extremely poor in character, noting in particular that he manipulated KakaoTalk conversations that had been exchanged with Kim Saeron, and that he publicly released a voice recording made with AI as though it were real, without any verification.

Q. “Did you properly verify the tipster from the Garosero side?”

Kim Seui: “Of course.”

Q. “How did you carry out that verification?”

Kim Seui: “That verification was done by the National Forensic Service.”

Q. “No. Did you do it yourself, by any chance?”

However, though Kim Seui claimed the verification had been done by the National Forensic Service, the entity that actually requested the verification was the police, and the National Forensic Service’s conclusion was that it could not be verified because the original was not available.

Kim Seui was confident the arrest warrant would be rejected, but the court, finding there was a risk of evidence destruction and flight, issued the warrant. He also filed for a review of the legality of his arrest, arguing the detention decision was unjust, but the court rejected that as well and maintained the detention.

Yu Hyunjae, Professor of Mass Communication at Sogang University said:

“Beyond fake news, now I see they actually manufacture things. This person has shown very clearly just how far someone who has given up all moral standards can go in terms of the scenario they will run, and the level of crime they can commit. So I believe that to the extent society allows, an extremely heavy punishment must be imposed.”

The Garosero Institute YouTube channel has 1 million subscribers and has been making money through provocative claims and videos targeting politicians, celebrities, and other public figures. In the process, countless people have had their privacy and personal dignity violated and suffered serious harm. Because of this, the Garosero Institute has been widely condemned as a social weapon.
