Woman withdraws complaint after marrying the man she earlier accused of false promise to marry: Supreme Court questions rushed FIRs

In a unique turn of events, a woman who had earlier filed a complaint alleging false promise to marry and dowry demands informed the Supreme Court that she has now married the same man she had accused.

During the hearing, the bench asked the couple about their background and remarked that this is precisely why individuals should avoid rushing to the police with such complaints when disputes arise.

The woman’s counsel told the Court that the complaint was filed in confusion and that both are now living happily together. The woman has moved to Bengaluru and is looking for a job there, while the man confirmed that he had not been threatened or coerced into marriage.

The bench observed that misunderstandings between families often escalate into criminal complaints, and once emotions settle, the couple reconciles. The Court noted that such situations highlight the need for restraint and thoughtful decision-making before invoking criminal law in relationship disputes.

Kerala High Court quashes rape charge filed by married woman on false promise of marriage

The Kerala High Court has quashed rape charges against a man accused of having sexual relations with a married woman on the alleged promise of marriage, ruling that a subsisting marriage invalidates claims of consent based on “misconception of fact.”

The Court observed that the complainant was legally married and therefore incapable of entering into another valid marriage, making her claim of consent under a false promise legally unsustainable. Continuing the prosecution, the Court said, would amount to “an abuse of the process of law.”

The ruling was passed under Section 528 of the Bharatiya Nagrik Suraksha Sanhita (BNSS), which empowers High Courts to exercise inherent jurisdiction to prevent misuse of judicial proceedings.

The complainant had alleged that she consented to sexual intercourse believing that the accused would marry her. However, she admitted that her marriage was still ongoing, though she had been living separately from her husband for over two years.

The Court, referring to Supreme Court precedents, clarified that not every claim of a broken promise amounts to rape, and that in this case, there was no statutory or social possibility of a legitimate marriage between the parties.

“The complainant was already married and the mother of a minor child. Her marriage was still subsisting when the alleged incident occurred. Therefore, the relationship in question cannot be treated as rape under Section 375 of the IPC,” the Court said.

The Bench concluded that the relationship, even if accepted as consensual, did not constitute an offence under Section 376(2)(n) of the IPC, which applies to repeated acts of rape.
