Our latest report on CNN keeps the international spotlight on Tanzania
Kenyans need not be alarmed by the good-as-dead the Constitution of Kenya (Amendment) (No. 2) Bill, 2024, sponsored by Senator Samson Cherarkey. The Senate's Standing Committee on Justice, Legal Affairs and Human Rights, where I am a member, conducted a thorough review of the Bill, and after careful consideration, the Committee unanimously recommended that the Senate rejects the Bill in its entirety, and advised the sponsor to withdraw it but he declined.
The Committee’s report documents that the Bill is fundamentally inconsistent with both the letter and spirit of the Constitution of Kenya, 2010. It raises more constitutional difficulties than it purports to resolve.
Although the Bill is scheduled to proceed to Second Reading in the Senate, the constitutional amendment threshold under Article 256(1)(d) requiring at least a two-thirds majority in both Houses at both Second and Third Readings, renders its passage politically and practically unviable. In short, while technically still alive, this Bill is, in practical terms, dead.
I reaffirm my unwavering commitment to defend the Constitution of Kenya, 2010 and to resist any attempts, however cloaked, to alter it for short-term or partisan advantage.
Thank you, Senator @OkiyaOmtatah for being the Kenyan people’s eyes in the Senate and checking this regime to avert turning our beloved country into a total autocracy.
We must continue to push for us to #tekelezakatiba and fight off any attempt to obliterate our Constitution #Ukatiba
