For the most part, I believe members of the U.S. Senate fully support John Thune and all his efforts to stop President Trump's America First agenda, and here's why. They could've replaced Thune 6 months ago with someone who could actually lead and get the job done, but they chose not to. Am I right or wrong?

Supporters see it as fair turnabout: if a prosecutor brings charges that a jury flatly rejects, accountability should flow both ways, not just toward the defendant. Critics argue prosecutorial discretion — even when a case ultimately fails — is different from malicious intent, and that malicious prosecution claims face a genuinely high legal bar for good reason.

Whether the suit succeeds will come down to whether Penny's team can show Bragg's office acted with actual malice, not just that they lost the case.
