Bei den EU-Sanktionen handelt es sich materiell um Strafmaßnahmen. Sie werden ohne gesetzliche Strafnorm, ohne Gericht und ohne Anhörung des Betroffenen von Politikern verhängt. Das verstößt gegen den Grundsatz ‚nulla poena sine lege‘ und gg grundlegende prozessuale Rechte des Beschuldigten. Der Name ‚Sanktion‘ ändert daran gar nichts.

Die Erklärung der Bundesregierung und EU-Kommission, es sei ‚nur eine Sanktion und keine Strafe‘, ist eine abwegige Schutzbehauptung. Genauso gut könnte man das Strafgesetzbuch in ‚Gute-Sanktionen-Gesetz‘ umbenennen – aus einer Strafe wird dadurch keine Sanktion. Die Pflicht zu einem fairen Verfahren nach Grundgesetz und Menschenrechtskonvention bleibt bestehen.

That’s not the scandal. The scandal is WHY Qatar and Netanyahu had to fund Hamas:

And that’s because for the last 19 years and counting, the state of Israel, regardless of who ran the government, has imposed a TOTAL air, land and sea blockade on the Gaza Strip.

They have prohibited the free movement of people and products. They have instituted complete control over trade, commerce and the production of goods and services.

Israel was, and still is, occupying both Gaza and the West Bank.

And as the occupying power they are obligated under international law to provide necessities. But because it’s Israel, of course they refuse to pay for that. So for decades the onus has fallen on Muslim countries and allies of Palestinians in the region.

Before 2012 Hamas leadership was in Syria. At the start of the Syrian war, the US asked Qatar to host Hamas instead. Qatar, wanting to curry favor with the US, agreed.

Those “payments to Hamas” have gone mostly towards paying Israel for the electricity they provide to Gaza ($10 million/month) and operation of the government facilities in Gaza like schools and hospitals.

So the scandal here is how “the only Democracy in the Middle East” has spent decades holding millions captive in an open air prison, guarded by robotic machine guns and denied them basic human rights why shaking down other countries to pay for it all.

Das nennt sich Sippenhaft oder auch Kollektivhaftung. Das letzte Mal, als Sippenhaft in Deutschland eingesetzt wurde, war im Dritten Reich. Wer dagegen jetzt nicht aufsteht, macht sich mit einem neuen Totalitarismus und Faschismus in Deutschland gemein.

Ich mache hiermit von Artikel 20, Absatz 4 des deutschen Grundgesetzes Gebrauch, wonach das Recht zum Widerstand gegen jeden besteht, der versucht, die staatliche Ordnung zu beseitigen:

„Gegen jeden, der es unternimmt, diese Ordnung zu beseitigen, haben alle Deutschen das Recht zum Widerstand, wenn andere Abhilfe nicht möglich ist.“

Andere Abhilfe ist nicht möglich: Herr Dogru hat es bereits via Eilantrag auf gerichtlichem Weg versucht. Dieser wurde abgelehnt. In zeitlichem Zusammenhang mit der erneuten Berichterstattung über den abgelehnten Eilantrag wurde nun auch das Bankkonto seiner Ehefrau gesperrt, und seine Familie damit in Kollektivhaftung genommen. Das ist mit unserem Grundgesetz nicht vereinbar. Selbst Straftäter haben Grundrechte, und Herr Dogru hat noch nicht einmal eine Straftat begangen. Hüsseyin Dogru und seine Familie werden einzig und allein für seinen Journalismus ihrer Grundrechte beraubt.

Ich erneuere daher hiermit mein Angebot: Ich bin bereit, Herrn Dogru und seiner Familie vor laufenden Kameras Sachspenden und Geld zu überreichen. Angesichts der humanitären Notlage der Familie ist friedlicher ziviler Ungehorsam das einzige Gebot der Stunde. Eine unterlassene Hilfeleistung an eine Familie in Not könnte ich mit meinem Gewissen nicht vereinbaren.

Ich bitte darum, vor Anfragen an mich, wie und wo man Herrn Dogru unterstützen kann, abzusehen, denn mir liegen aktuell leider keine Informationen über entsprechende Aktionen vor. Herr Dogru muss selbst entscheiden, ob er dem zustimmen würde. Es bedeutet für ihn das Risiko einer Straftat - ebenso wie für alle, die ihm helfen wollen. Ich denke, dass es an diesem Punkt, mit 104 Euro Barguthaben und einer bevorstehenden Obdachlosigkeit, nicht mehr viel zu verlieren gibt. Die Entscheidung, ob er öffentlichkeitswirksam Hilfe annehmen will, kann ihm jedoch niemand abnehmen. Ich für meinen Teil bin bereit, das Risiko zu tragen.

Es ist ein Punkt gekommen, an dem unser Staat sich nackt machen muss: Möchte er tatsächlich Menschen kriminalisieren, die einer Familie in Überlebensnot Lebensmittel, Babynahrung, Windeln und Geld zukommen lassen wollen?
