тАЛ1. Claim: A two-thirds (2/3) majority in Parliament is required to abolish reservations.
Rebuttal: Absolutely not. Reservation is not a fundamental or constitutional right; it depends entirely on the will of the state and central governments. The central government and state governments can abolish SC, ST, and OBC reservations through a simple Government Order (GO).
тАЛ2. Claim: To bring reforms in reservation, to exclude any caste from reservation, or to implement the creamy layer in SC/ST, a constitutional amendment will be required.
Rebuttal: Absolutely not. The central government holds absolute power to exclude any caste from the reservation list and to apply a creamy layer in any category. Since reservation is not a mandatory right, the central government can make this decision whenever it wants.
тАЛ3. Claim: Reservation is necessary for the unity of the Hindu religion.
Rebuttal: Absolutely not. The BJP government itself is providing OBC reservation to 90% of the country's Muslims, even though it is entirely within the government's power to remove Muslims from this reservation (since Muslims were not historically exploited in that manner, nor did they ever pay Jizya). But the BJP will never remove them; it only takes votes in the name of Hindus.
тАЛ4. Claim: The BJP cannot exclude castes like Jat, Ahir, Meena, and Kurmi from reservation, because a bill for this would have to be passed in the Lok Sabha and State Assemblies.
Rebuttal: Absolutely not. It is clearly written in the Constitution that castes that are 'over-represented' (represented beyond their proportion of the population) cannot be given reservation. All these castes are over-represented in government jobs. The BJP government only needs to show the data of the total number of government employees along with the employees from these castes, and they can be excluded from reservation by issuing just a Government Order (GO).
