MJJ Repository: Archiving the facts and history of Michael Jackson. Uncovering the truth through court records and extensive analysis.

[TSCM @MJJRepository]

MJ's scandals can't be explained in a soundbite, which is what the media expects (Gayle offered Weitzman 30 seconds to rebut LN in '19).

But Season 1 of @Case4Innocence presents more than 15.5 HOURS of fact-based, heavily researched material on them all.

@Keb_187 Well, if we ignore the weirdness of that claim by James.

He told Gayle in 2019 that he likely would had taken this to his grave if MJ were alive.

He told Oprah he didn't consider it as abuse until seeing Wade in 2013.

But Steph danced in 09 "He CaN'T HuRT AnYMoRE ChiLDreN!" 🤔

9) Failure to File a Creditor's Claim

"JS already petitioned to file a claim against the Estate based on these exact same false allegations. Court dismissed that petition with prejudice in 2015—this lawsuit is simply an attempt to end-run the law, which clearly precludes JS."

[TSCM @MJJRepository]

@Keb_187 Wade and Jordan both had the rare opportunity to help convict—as kids and adults.

Instead Wade sat through 11 rounds of brutal examination to credibly defend MJ's innocence.

Jordan fled.

James says he told mom MJ abused him in 2005 and was a "bad man" yet neither did anything.

@Keb_187 Carpenter has often been a point of delay, including long scheduling conflicts.

Before he took over it was Finaldi who suggested they needed more time to prepare the cases, especially James' than the estate.

But the public spin: "Delayed due to biopic!"

https://t.co/PiEPIb2wEd

[TSCM @MJJRepository]

Earlier this year, the media claimed the estate was delaying due to the biopic and to "silence" WR/JS and that Carpenter wanted a trial by April '25.

But in legal filings Carpenter agreed with the defense that discovery "is in infancy" and a 2026 trial date is fully reasonable.

WADE & JAMES CASE: New Proposed Timeline (Late-2028)

Ahead of an upcoming hearing, another joint status update has been filed.

Both sides proposed another extended delay:

Feb. 28, 2028 - Written Discovery Cut-Off

May 15, 2028 - Deposition Cut-Off

November 13, 2028 - Trial

@Lovelife4b "These allegations are false—I intend to vigorously defend—I will not allow false accusations to define my decades of public service."

In 2005 as a pundit covering the MJ trial she didn't mind accepting allegations at face value before any trial & even after his acquittal.

Odd.

[TSCM @MJJRepository]

"Either Wade is perjuring himself today in an effort to obtain money, or he perjured himself & obstructed justice in a criminal proceeding a decade ago. There is no middle ground between those two positions—a recovery here would make a mockery of California's system of justice."

[TSCM @MJJRepository]

The preliminary statements are worth resharing.

"A meritless sham."

"Wade recanted his testimony in a criminal trial for the sole & express purpose of taking money away from MJ's children, heirs & beneficiaries. Wade's complaint does not and cannot seek anything other than 🤑."

[TSCM @MJJRepository]

7) Comparative Fault: Alleged damages are largely due to the fault of others, alleged damages recoverable must be offset and reduced entirely or by the percentage of allocable fault.

8) Proposition 51 Apportionment: Similar concept as above, as a refined argument and defense.

[TSCM @MJJRepository]

Continuing affirmative and alternative defenses ("not to be construed as an admission"):

3) Barred full or in part, on the grounds that JS engaged in acts and/or courses of conduct constituting fraud on Defendants.

4) Barred entirely by applicable statutes of limitations.

[TSCM @MJJRepository]

6) No Causation: JS cannot show that any acts or omissions of the Corps caused him damages.

"When MJ was frivolously accused in 93 & investigated, JS defended MJ and rejected the allegations, including false allegations that MJ had engaged in wrongdoing w/ Safechuck himself."

[TSCM @MJJRepository]

5) Violation of Due Process...Fundamental Fairness

"JS waited almost four years after MJ died before he made his scurrilous and frivolous allegations. The nature
of these false allegations necessarily makes it impossible for the Corporations to fully defend themselves w/out MJ."

[TSCM @MJJRepository]

Defense lists 18 affirmative and alternate defenses:

1) TAC fails to state facts sufficient to constitute a cause of action against the Corps.

2) Bad Faith, Frivolous Action, Inequitable Conduct: "JS claims he made false statements to police & obstructed justice in the past."

[TSCM @MJJRepository]

The proposed amended answer to James's 3rd amended complaint (TAC) recites defenses.

Starting with general & specific denials: "The TAC fails to state any legitimate causes of action and the Corporations will be filing motions for summary adjudication / judgment in due course."

[TSCM @MJJRepository]

The estate notes how recent depositions taken as part of Safechuck's case likewise support this:

"Over the last several months, significant confidential deposition testimony in Safechuck's case has emerged that readily supports the comparative fault and Proposition 51 defenses."

[TSCM @MJJRepository]

The defense emphasizes how much of the existing discovery and depositions already explored theories of comparative fault, which the estate also asserted nearly 8 years ago in a reply to Wade's complaint.

That, combined with the 2+ years before trial would not prejudice the case.

[TSCM @MJJRepository]

A 2nd hearing is planned for Nov. 5 seeking to allow MJ's side to amend their answers to the complaints, in order to introduce additional arguments that could reduce any amount owed in the event of a loss.

Carpenter did not volunteer to allow this, so the estate filed a motion.

[TSCM @MJJRepository]

The nature of the amendments centers around holding "other 3rd parties—who Plaintiffs did not sue" to their claims.

"Defendants adamantly dispute that MJ ever abused any child. Indeed, Plaintiffs & their parents were among MJ’s strongest supporters until well after his death..."

[TSCM @MJJRepository]

As mentioned previously, the parties are also seeking to appoint two additional discovery referees to mitigate complications when working around the current referee's limited schedule for depositions and other matters.

With 3 referees, disputes could be addressed more promptly.
