@nivekllaxoc@bushontheradio I know, right? Here’s another Martinism, ‘Nivek’ - you want to build a new floor on those apartments? Guess where it goes - yep, that’s right, in the airspace above; the airspace that you own.
@estnonmeaculpa@bushontheradio Yes they do (landowners) - look at the legal maxim Cuius est solum, eius est usque ad coelum et ad inferos. Obviously the extent is fact specific and the courts have moulded this over the years, but you own the airspace above your house. You don’t need to buy it to build into.
@shearersbuddy@outcold8996@bushontheradio This sums up the position on airspace quite well. Clearly I shouldn’t have said “all”, but that did use to be the case.

@outcold8996@bushontheradio I shouldn’t have said “all” airspace, although that used to be the case. You own what is necessary for reasonable enjoyment. You wouldn’t be able to build upwards otherwise. This is fact specific but look up the maxim cuius est solum, eius est usque ad coelum et ad inferos.
@banturegion@bushontheradio “All” is not - you own what is required for reasonable enjoyment, which is subjective and fact specific. How else would you build upwards if you didn’t own the airspace?

I shouldn’t have said “all” - that is bullshit. But you do own the airspace up to a point. You wouldn’t be able to build upwards otherwise.
