২৬ মে বিশ্বজুড়ে আন্তর্জাতিক হকার দিবসে আমার খেটে খাওয়া হকার ভাই বোনেদের জানাই অভিনন্দন। তার সাথে তাঁদের জানাই সমবেদনা। যেভাবে পশ্চিমবঙ্গে ক্ষমতায় এসেই বিজেপি সরকার হকারদের উপর অত্যাচার চালাচ্ছে, উচ্ছেদ করছে, তাদের দোকান ভেঙে দিচ্ছে, তাদের চোখের জলকে তোয়াক্কা না করে তাদের পথে বসাচ্ছে সেটা দেখে আমি বিস্মিত, ক্রুদ্ধ, মর্মাহত। অত্যাচারীরা এর জবাব নিশ্চয়ই পাবে। আপনাদের পাশে ছিলাম, আছি, থাকবো।

পথচলতি বিক্রেতা, হকার এবং অনানুষ্ঠানিক ক্ষেত্রের ক্ষুদ্র ব্যবসায়ীরা যেভাবে স্থানীয় অর্থনীতির মেরুদণ্ড হিসেবে কাজ করেন, এই দিনটি মূলত তাঁদের সেই অবদানকে স্বীকৃতি জানানোর জন্য উৎসর্গীকৃত।

হকার অর্থনীতির বাস্তব চিত্র
রাস্তার হকাররা হলেন একেবারে তৃণমূল স্তরের অর্থনীতির প্রতীক। তাঁরা একদিকে যেমন বড় মাপের উৎপাদন ব্যবস্থার সাথে সাধারণ মানুষের দৈনিক চাহিদার যোগসূত্র তৈরি করেন, অন্যদিকে ঠিক তেমনই অত্যন্ত সুলভ মূল্যে জরুরি পণ্যসামগ্রী মানুষের দোরগোড়ায় পৌঁছে দেন। তবে এই ব্যবস্থার টিকে থাকা এবং নগর পরিকল্পনার মধ্যে সবসময়ই একটি সূক্ষ্ম ভারসাম্য বজায় রাখতে হয়:

অর্থনৈতিক অবদান: উন্নয়নশীল দেশগুলির কর্মসংস্থানে এই অনানুষ্ঠানিক ক্ষেত্রটির ভূমিকা অপরিসীম। হকাররা লাখ লাখ মানুষের স্বনির্ভরতার পথ তৈরি করেন, যার ফলে বহু নিম্নবিত্ত পরিবার কর্পোরেট বা সরকারি চাকরির ওপর নির্ভর না করেই জীবিকা নির্বাহ করতে পারে।

পথচারী ও স্থায়ী দোকানদারদের অধিকার রক্ষা করার পাশাপাশি হকারদের রুটি-রুজি —এই দুইয়ের মধ্যে ভারসাম্য বজায় রাখতে ভারতে ‘স্ট্রিট ভেন্ডর (সুরক্ষা ও নিয়মকানুন) আইন, ২০১৪’ (Street Vendors Act, 2014) পাস হয়েছিল, যাতে যানজট এড়ানো যায় আবার হকারদের আকস্মিক উচ্ছেদ থেকে সুরক্ষা দেওয়া যায়।

একটি আদর্শ ও সুপরিকল্পিত শহরের লক্ষ্য হকার উচ্ছেদ করা নয়, বরং তাঁদের শহর ব্যবস্থার অঙ্গ করে নেওয়া। হকারদের জন্য সুশৃঙ্খল ও পরিকাঠামোযুক্ত পুর-বাজারের ব্যবস্থা করা গেলে পথচারীদের নিরাপত্তাও বিঘ্নিত হয় না, আবার শহরের প্রাণবন্ত ক্ষুদ্র-অর্থনীতিও সচল থাকে।

মাননীয় সুপ্রিম কোর্ট বিভিন্ন ঐতিহাসিক রায়ের মাধ্যমে হকারদের অধিকারকে আইনি স্বীকৃতি ও সুনির্দিষ্ট রূপ দিয়েছেন। গত কয়েক দশক ধরে শীর্ষ আদালতকে সংবিধানের ১৯(১)(ছ) অনুচ্ছেদ [Article 19(1)(g)] অনুযায়ী হকারদের স্বাধীনভাবে ব্যবসা বা জীবিকা অর্জনের মৌলিক অধিকার এবং জনসাধারণের পরিষ্কার ও নিরাপদ রাস্তায় চলাচলের অধিকারের মধ্যে ভারসাম্য বজায় রাখতে হয়েছে।
যেমন,

১. বোম্বে হকার্স ইউনিয়ন বনাম বোম্বে মিউনিসিপ্যাল কর্পোরেশন (১৯৮৫)
রাস্তার হকিং বা হকার ব্যবস্থা নিয়ে পদ্ধতিগতভাবে আলোচনা করা প্রথম দিকের অন্যতম গুরুত্বপূর্ণ মামলা এটি। সুপ্রিম কোর্ট স্বীকার করে যে হকারদের জীবিকা নির্বাহের অধিকার রয়েছে, তবে জনস্বার্থ ও যাতায়াতের সুবিধার কথা মাথায় রেখে এই অধিকারের ওপর 'যুক্তিযুক্ত নিষেধাজ্ঞা' জারি করা যেতে পারে।

২. সোদান সিং বনাম নিউ দিল্লি মিউনিসিপ্যাল কমিটি (১৯৮৯)
হকারদের সাংবিধানিক মর্যাদার ক্ষেত্রে এই রায়টিকে সবচেয়ে মৌলিক এবং ভিত্তিপ্রস্তর হিসেবে গণ্য করা হয়। সুপ্রিম কোর্ট অত্যন্ত স্পষ্টভাবে ফুটপাথের ব্যবসাকে মৌলিক অধিকারের সাথে যুক্ত করে।

৩. গেন্দা রাম বনাম মিউনিকিপাল কর্পোরেশন অফ দিল্লি (২০১০)
হকারদের সুরক্ষায় বর্তমান আধুনিক আইন প্রণয়নের পেছনে এই মামলাটিই ছিল সবচেয়ে বড় অনুঘটক। নির্দিষ্ট কোনো আইনি কাঠামো না থাকায় হকারদের যেভাবে বারবার স্থানীয় প্রশাসনের মর্জির ওপর নির্ভর করতে হতো এবং উচ্ছেদ বা তোলাবাজির শিকার হতে হতো, তা দেখে সুপ্রিম কোর্ট গভীর উদ্বেগ প্রকাশ করে।

ফলাফল: আদালতের এই স্পষ্ট ও বাধ্যতামূলক নির্দেশের ফলেই পরবর্তীকালে তৈরি হয় ‘স্ট্রিট ভেন্ডর (সুরক্ষা ও নিয়মকানুন) আইন, ২০১৪’ (Street Vendors Act, 2014)।

৪. মহারাষ্ট্র একতা হকার্স ইউনিয়ন বনাম মিউনিসিপ্যাল কর্পোরেশন অফ গ্রেটার মুম্বাই (২০১৩)
২০১৪ সালের কেন্দ্রীয় আইনটি কার্যকর হওয়ার ঠিক আগে সুপ্রিম কোর্ট এই মামলার রায়ে গেন্দা রাম মামলার নির্দেশিকাকে পুনরায় পুনর্ব্যক্ত করে, যাতে অন্তর্বর্তীকালীন সময়ে হকারদের সুরক্ষা দেওয়া যায়।

আদালতের আইনি অবস্থানের সারসংক্ষেপ
এই সমস্ত রায়ের মাধ্যমে সুপ্রিম কোর্ট একটি স্পষ্ট আইনি মতবাদ (Legal Doctrine) প্রতিষ্ঠা করেছে:

জীবিকার অধিকারকোনো সমীক্ষা বা বিকল্প ব্যবস্থার সুযোগ না দিয়ে আকস্মিক বা খামখেয়ালি উচ্ছেদ করা সংবিধানের ২১ অনুচ্ছেদ (জীবন ও জীবিকার অধিকার)-এর লঙ্ঘন। নিয়ন্ত্রণ ব্যবস্থাহকারদের অধিকার পরিচালনার দায়িত্ব টাউন ভেন্ডিং কমিটি (TVC)-র মতো গণতান্ত্রিক ব্যবস্থার মাধ্যমে হতে হবে, যাতে নগর পরিকল্পনায় হকারদের নিজস্ব মতামত প্রতিফলিত হয়।

Delhi holds on to its dubious distinction as the RAPE CAPITAL of India. In a harrowing echo of the Nirbhaya tragedy, an innocent 11-year-old girl, eking out a living by selling roses at traffic signals, was abducted, raped, and abandoned in an unconscious state in a forested area.

PM Narendra Modi and HM Amit Shah visit Bengal and speak of ‘Poriborton.’ Perhaps that 'Poriborton' should begin in BJP-ruled states first. A government that cannot ensure women’s safety, provide clean air and water, or prevent deadly blasts has no moral authority to come to Bengal and seek votes.

Hope we see outrage from the self-righteous BJP leaders. Hope a fact-finding team is sent to Delhi. Hope the NCW takes cognizance and conducts an inquiry. Hope the Godi media runs wall-to-wall coverage on this.

Sure, IGNOU has its fair share of issues and whatnot, but it really breaks my heart when people think it’s somehow ‘less.’
Behind every IGNOU degree, there's a story that would humble you. 

I've interviewed people who borrowed books because they couldn't afford them. Who took exams while working double shifts to support their families. In some cases, it gives people a second chance at having a career. In a country where institutions keep failing us, IGNOU deserves more credit.

Yes, IGNOU has delays. Yes, the system is imperfect. But it's democratizing education in ways that matter. It's giving millions a shot at dignity, at economic mobility, at proving that circumstances don't define potential. It's turning watchmen into managers, housewives into entrepreneurs, daily wage earners into professionals.

When we see that IGNOU degree on a CV, we should not see a "lesser" qualification. We should see someone who climbed a mountain without a safety net. It’s life-changing for the person and their family.

In a country obsessed with elite institutions, IGNOU quietly changes millions of lives, one distance learner at a time. It really fills my heart up.

The Union Government, despite having the support of the Opposition parties and the entire nation, still lacks the courage to reclaim PoJK. It beats its chest with hollow rhetoric, but when it comes to defending India’s sovereignty, protecting our borders and acting firmly against our enemies, it shows no real resolve.

Having failed in its attempt to misuse the EC to implement SIR, the government has now activated another “E” — ED - to bring in laws that target opposition leaders, crush democracy and manipulate the people’s mandate by toppling State Govts.

This government has proven itself to be anti-people, anti-farmer, anti-poor, anti-SC, anti-ST, anti-OBC, anti FEDERAL and above all ANTI INDIA.

One vote to the BJP is nothing less than SELLING THE SOUL OF INDIA. It is selling the Constitution of our country and allowing INDIA to be run as private property in the hands of INCOMPETENT OBSESSIVE TYRANTS!

The INDIA built on the ideals of GANDHI and AMBEDKAR will not surrender its soul to dictators and power-hungry rulers.

A young boy from Konnagar lost his life today following a road accident, after BLEEDING FOR 3 HOURS WITHOUT RECEIVING MEDICAL ATTENTION, a consequence of the ongoing protest by doctors in response to the #RGKar incident. While the demands of the junior doctors are both fair and valid, I urge them to protest in a way that doesn't disrupt essential medical services. Allowing a death due to PREVENTABLE NEGLECT is tantamount to CULPABLE HOMICIDE. If the protest has to continue, it should be done constructively, with empathy and humanity, ensuring no more lives are put at risk through inaction or neglect. 🙏🏻
