If he is a specialty trained unit, with a decade of experience, then why did he break basic protocol and:
-illegally engage a US citizen
-step in front of a car
-film on his phone
-fire at a moving vehicle
-flee the scene
All of which the DHS’s own manual says NOT to do!
Spoke on background with two attorneys who have defended officer involved shootings.
Both have always taken their cases to trial.
After reviewing the events today, both said if it were their client they’d advise:
-Seek a plea deal
-Be willing to plead guilty to a lesser crime or a lower sentence
-Accept anything that isn’t de jure LWOP (life with out parole)
In other words, the guys who defend police officers shooting for a living, think this case is unwinnable.
They would try to defend his actions, they’d just try and lower the impact of the outcome.
Their main sticking point were:
-“I could argue shot number one and hope for an acquittal or a hung jury - but I can’t get there on shots 2 and 3”
-“A jury will not get passed the turning of the wheels”
-“Denying medics throws self defense out the window”
it's great to know if a federal agent shoots you in the face the entire government will publicly slander you as a domestic terrorist before ambulances even arrive
Let's be even more clear about this:
-ICE's jurisdiction is ONLY on matters related to immigration.
-They do NOT have normal police powers or authorities.
-To stop a vehicle they MUST have reasonable cause to believe it contains an undocumented immigrant.
-To draw their weapon on someone they MUST have reasonable cause that their lives are in *DIRECT* danger.
-They CANNOT detain you with out reasonable cause to believe you are undocumented.
-They CANNOT detain a US citizen for passing-by the area.
Ice had NO jurisdiction to stop or interact with this woman at all, never mind pull out a gun.
ngl it brings me to tears seeing this kind of laborious commitment to craft in an industry that increasingly avoids effort and bends over backwards to reduce time & expense. everything about this episode’s visual/filmic thoughtfulness really really moved me.
