Americans have always hated and disbelieved the "not guilty by reason of insanity" defense -- despite knowing little or nothing about it.

In 1983, a survey on the verdict of John Hinckley Jr., who was found NGRI, identified only *one* respondent could accurately describe the elements of the NGRI defense.

66% of respondents believed Hinckley was not legally insane -- even though he was diagnosed schizophrenic, believed he could achieve "magical unification with Jodie Foster" by shooting Ronald Reagan, tried to kill himself twice in jail, and started threatening to rape and kill Jodie Foster once he was sent to the psychiatric hospital.

62% of respondents believed Hinckley would be released from state confinement after two years or less. Hinckley was ultimately confined for over 35 years. Only in 2022 were all his state-imposed restrictions lifted.

@yungleangroyper Yeah except Lindsay has never been found to be "malingering." Even the prosecution's witnesses concede her mental illness. And that guy's "malingering" was many years after the crime, when he was trying to appeal his death sentence. Nice "parallels" though

Yes -- if Lindsay is found "not guilty by reason of mental illness or mental defect," she would immediately return to a state-controlled psychiatric facility. A hearing would then be held within 40 days to evaluate her mental status; if deemed mentally ill, she would be confined for another six months. Hearings to renew her civil commitment would then be held once a year. To remain committed, a finding would only need be made that she is "mentally ill." Which means she could easily remain confined in perpetuity.

People act like Lindsay would prance right out of the courthouse and giddily proclaim "FREEDOM"! Which is just so stupid. (And anyway, she couldn't prance -- she's paralyzed from the waist down, if you weren't aware, because she jumped out of a friggin' window and shattered her lower spine.)

If Lindsay Clancy is found not culpable by reason of insanity, she will then be confined in a state mental hospital for a very long time, yes?

I don’t understand why people are acting like a not guilty verdict would set her up at a resort or something.

I fully support bringing back mental institutions instead of putting demonstrably crazy people in prison.

People just dopily assume that to be found "not guilty by reason of insanity" means the defendant "beat the wrap" -- but insanity acquittees are often confined to psychiatric facilities LONGER than similarly-situated defendants remain in prison following a standard guilty verdict
