1. 公投來自公民投票法，之前的公投多屬創制權的後者，的確沒有實際的約束
2. 釋憲是憲法的延伸解釋，除非與憲���本身衝突而無效化，不然還是大於立法院可以創設的法律位階，所以我才說有一件就往上去修憲阿老哥
