The Tak Bai massacre case is officially over, according to a court announcement on Monday, after all seven defendants failed to report to the judges by the Friday deadline.

The tragic case was closed after the accused did not appear at the court before 11.59pm on Friday.

The Narathiwat Provincial Court accepted jurisdiction over the lawsuit against officials suspected of being responsible for the human rights violations during the Tak Bai protest in 2004. The statute of limitations was set to expire on October 25, but the court accepted the case today.

The lawsuit was filed by the victims and their families against nine defendants:

- Defendant 1: Former Commander of the Fourth Army Area
- Defendant 2: Former Deputy Commander of the Fourth Army Area
- Defendant 3: Former Commander of the Fifth Infantry Division
- Defendant 4: Former Director of the National Police Office Forward Operations Center
- Defendant 5: Former Commander of Police Region 9
- Defendant 6: Former Superintendent of Tak Bai Police Station
- Defendant 7: Former Deputy Superintendent of Tak Bai Police Station
- Defendant 8: Former Deputy Director of the Southern Border Provinces Administrative Center (SBPAC) and Deputy Permanent Secretary of the Ministry of Interior
- Defendant 9: Governor of Narathiwat Province at the time

Background:

On October 25, 2004, over 2,000 protesters gathered at Tak Bai police station in Narathiwat Province, demanding the release of six Malay Muslim men believed to have been arbitrarily detained. Security forces used tear gas, water cannons, and live ammunition, killing seven protesters, five of whom were shot. About 1,370 detained men were then transported to Ingkayut Borihan Military Camp in Pattani, 150 kilometers away. During transit, 78 died from crushing or asphyxiation, and many survivors suffered severe injuries and permanent disabilities.
