My article on Waller Edwards v OSB, in which I succeeded in the Supreme Court, appears today in the International Journal of Banking Law. It is entitled “The Supreme Court tweaks Etridge.”
The SCt heard me for 2 hours on 27 February 2025 and largely agreed with my submissions. Special thanks to Julian Malins KC and Joel Leigh at Howard Kennedy for accepting my invitations to come into the case on CFAs in the SCt. We were a powerful team.
I’m delighted to announce a victory in the Supreme Court in Waller Edwards v One Savings Bank. Details including video are on the Supreme Court website. This is an important variation on the Etridge principles of constructive notice as applied to hybrid mortgage transactions.
