Clearly, payment in lieu of notice must be consented to by the employee for the termination to be lawful.

Does payment in lieu of notice substitute the requirement for notice prior to termination? My answer is no.

S.2 of the Employment Act defines termination of employment to mean the discharge of an employee from employment at the initiative of the employer for justifiable reasons

and is prohibited under s.69(2). The exception is under s.69(3) of the Act and this is where an employee has by his or her conduct indicated that he or she has fundamentally broken his or her obligation arising under the contract of service.
