Imagine Foundational-Black /Antebellum-Black Americans Governing their own States and Possessing their own State Supreme Court Justices

The Structure of State Power and Federalism

Unlike unitary governments, where a central authority holds plenary power over local government and institutions, the United States operates under a system of Federalism.

State Sovereignty: Each of the 50 states functions with many of the attributes of an independent nation (such as Italy, Spain, or France), complete with:

An Executive branch led by a Governor serving as Commander-in-Chief.

A Legislative branch consisting of state representatives & assembly members.

A Judicial branch anchored by a State Supreme Court.

A State Constitution & dedicated State Defense Forces.

Constitutional Authority: Under the 10th Amendment, states retain specific Reserved & Shared powers that are explicitly protected by the U.S. Constitution.

Frederick Delk's Proposal for Regional Self-Governance

Recognizing these powerful state-level authorities, Frederick Delk proposes a political strategy for Foundational-Black / Antebellum-Black / Anglo-Black Americans:

Independent Political Party:

Establish a dedicated political party focused on attaining a supermajority population & governing control over the 8 States Southern Region (North Carolina, South Carolina, Georgia, Alabama, Mississippi, Louisiana, Arkansas, & Tennessee).

Rationale: While the combined population of 52 million Black Americans (Antebellum-Black Americans (42 million) & Post-Bellum Black / African Americans & their children born in the USA 10 million is not large enough to command political control at the federal level, however it is large enough to achieve decisive governing control within this specific 8 Southern States footprint.

Key Capabilities of State-Level Control

The 50 States have Rights and Power, Antebellum-Black Americans can exercise Power through the State.

Securing governing control over these eight states would enable this constituency to wield powerful institutional levers, including:

Legislation & Regulation: Making & enforcing state laws, regulating intra-state commerce, taxing and regulating individuals, corporations, and institutions doing business within the state.

Constitutional Influence: Ratifying amendments to the U.S. Constitution and leveraging Electoral College votes in presidential elections.

Land Reform & Restitution: Enacting state-level land reform and recompense laws.

Judicial Protection: Utilizing State Supreme Courts (With Antebellum-Black Justices to interpret, intervene, and uphold state-level laws.

James Madison addressed the division of power between the Federal government and the states in Federalist No. 45 (1788): The powers delegated by the proposed Constitution to the Federal Government, are few and defined. Those which are to remain in the State Government are numerous and indefinite.
