The way Adv Chaskalson pushed for those in-camera sessions showed that he has uncovered some really serious and important information, backed by a huge amount of evidence. He’s been working flat out to get everything ready and needed to put it on record on Tuesday so the Commission could authorise the big steps that need the Commissioners’ approval.That can only happen once the evidence is formally on record. So General Khan’s instructing attorney, Mohamed Valley, wanted to postpone the in-camera session until Khan gets better and is discharged from hospital. But Adv Chaskalson fought hard for it to go ahead the next day, on the 8th. The Commission agreed and allowed it to proceed even without Mr Valley .
Now that General Khan’s in-camera session has taken place, I think they’ve got the green light to go after everyone implicated in those chats. This could mean summoning their phones and possibly even making arrests soon. What we saw in the open sessions was just the tip of the iceberg the real stuff, the really sensitive material, surely will came out in that in-camera session. We're probably talking about extortions, kidnappings, serious plotting, killings, and the protection of those who did the killing. Also the information that was shared about whistleblowers , right up to who killed them. There are so many scary things sure in that close door session , including evidence of how the slash-fund account was abused.Adv Chaskalson wanted all of that on record so he could get approval to go after everyone involved. This man is going to destroy the whole cartel.
They also put on record what they found on Cat Matlala’s side from Khan’s gadgets. That way, when Matlala submits his affidavit in response to the Section 106 notice, the Commission can check how consistent it is with all the other evidence they’ve gathered. This should completely crash that dodgy, secret, fake admission. Even the courts seem to want to push it out, or they’re waiting for the Commission to give them more on Cat so they know exactly what to do moving forward on the 13th when he comes back .
It’s clear that the evidence from General Khan’s devices is really damning. I suspect we could see arrests very soon. As Adv Chaskalson explained, they did it in-camera to avoid tipping off the people under investigation, who might try to run or destroy evidence . It looks like even IDAC is about to witness something ,with Mr Matlala. If he doesn’t listen to his lawyers’ advice (assuming they gave him some), we’re going to see a functioning state in action.
