— In a majority opinion authored by Justice Samuel Alito, the Court held that an alien standing in Mexico does not “arrive in the United States” by attempting, and failing, to enter the country.

An “asylum seekers” who are still physically standing in Mexico (on the Mexican side of the U.S.-Mexico border) have not yet “arrived in the United States” under federal law.

As a result:
• They do not have an automatic legal right to apply for asylum at that point.

• U.S. border officials can turn them away without processing their asylum claims.
