We are grateful to lawmakers and their staff for their time and the opportunity to share why this lifesaving program must be protected.
It’s cherry blossom and #340B advocacy season here in Washington, D.C.! We had the privilege of welcoming our members visiting us from more than 28 states, who met with lawmakers and their staff about the need to #Protect340B.

We appreciate @HRSAgov’s commitment to #340B and supporting safety-net hospitals but remain deeply concerned about 340B rebate model plans. @340BHealth’s recent analysis (https://t.co/pYr2jKip4z) shows the financial and administrative burdens rebates will place on hospitals, affecting their ability to deliver critical care services. With our mission to #Protect340B, we will continue working with HRSA so 340B remains strong and sustainable.

The program would apply only to the first 10 Medicare drugs subject to price caps in 2026, but HRSA might expand the program in future years.
While we recognize the agency’s intent to test a limited rebate model tied to #IRA implementation, we remain deeply concerned about the financial and administrative burdens the rebate approach will place on 340B hospitals.

Another key win: a second federal judge has allowed @340BHealth and member hospitals to intervene in the @JNJNews rebate lawsuit. This ensures we remain closely involved in the fight to block harmful rebate schemes that would burden #340B hospitals. #Protect340B

Last week, a federal judge granted our motion to intervene in @JNJNews’ lawsuit over the gov’s refusal to approve the company’s rebate scheme.
Alongside @GenesisHCS and @umassmemorial, we’ll have yet another opportunity to go to court and represent all 340B hospitals, which stand to experience severe financial harm if rebates proceed.

Today, @340BHealth participated in oral arguments defending against drugmaker #340B rebate schemes. We are joined by two members who, like many hospitals and health systems, have calculated tremendous financial costs and administrative burdens if rebates are allowed to take effect. #Protect340B
The #340B statute requires discounts at the point of sale, not as a rebate. This process is not only what has been in place for more than 30 years, but it’s also the most effective way for drugmakers to fulfill their obligation to the health care safety net.
