Commissioner Khumalo states none of the cases in October 2024 have anything to do with Mokwele. The matter of nepotism relates to other colonels. There were no cases of fraud opened. Padayachee says he'll have to check. Khumalo argues that cases opened in Orlando and Cape Town in the Section 27 affidavit do not relate to Mokwele.

PADAYACHEE QUESTIONED OVER "SNOOPING" AROUND FOR BRIGADIER MOKWELE'S NAME
Sello reminds Padayachee that the dockets have nothing to do with Brigadier Mokwele - Padayachee agrees. He's asked if Mokwele is only know in the A1-statement (Fadiel Adams affidavit). Padayachee agrees.
Sello suggest for an investigator officer such as Padayachee looking into the matter what would be the logical step to take.
Sello wants to establish the starting point.
Padayachee says he'd subpoena the documents from crime intelligence on the TSSU post. He says he discovered there was a civilain from BMW. Sello says hed expected Padayachee to request all documents from the National commissioner. Padayachee says that's what he did.
Sello wants to know why the specific documents [pic below] were requested. Sello she can't find anything about Mokwele in the docket. She says remember the target was to establish manipulation.
Padayachee says they already have details. Sello interjects and asks what she missed in the investigation file. Padayachee says she had the name and surname and therefore requested documents. Sello wants to know when in the docket it says how she acquired them.
Baloyi asks again how Padayachee got the name and where that is seen in the docket. Padayachee says that during the course of the investigation, you speak to people. Baloyi asks if Padayachee spoke to Human Resources and Crime Intelligence.
Padayachee says it could've been from one of the witness from crime intelligence environment. He says thats not in hes docket. Sello asks on what basis did he determine who to speak too. Padayachee says its people he knows from Crime Intelligence.
Sello asks why didn't he direct the question to the National commissioner... Padayachee says when you do investigation you speak to people. He says when they got the documents from the National commissioner all they had was her name and they had to investigate further
Sello says Padayachee comes across as though you can snoop around and ignore the national commissioner. She says he could have asked the national commissioner. Padayachee says snooping is part of the investigation, which was dynamic.
Padayachee is asked why other names were on the list (below) as part of his investigation and query regarding their vetting.
Padayachee says the individuals were implicated in other investigations being conducted.

Sello insists Padayachee speak about Khumalo. Padayachee says there's an investigation into Khumalo in relation to his vetting file.
Madlanga says he engaged Padayachee on the trigger, which he said he never saw the referral.
Madlanga says it buttresses the point that he must see the referral, or else he investigates in the dark.
Padayachee says what's important is that there are suspicions and allegations in the case. Padayachee insists he did a bona fide investigation and did nothing wrong. Madlanga says he did something wrong and he should have investigated beyond the statement of Fadiel Adams, and he should have gone to the chief. Madlanga asks if Padayachee disagrees.

Baloyi inquired whether the actions of Lieutenant-General Dumisani Khumalo align with SAPS protocol or if they contravene established SAPS directives. Padayachee affirmed that such conduct is considered standard practice.
Padayachee states that Khumalo would have selected the panel, with General Sibiya providing final approval, and the head office subsequently authorizing the decision.
The commission is currently assessing the legitimacy of the panel established for the appointment of Brig Mokwele.
Commissioner Khumalo stated that IDAC inquired as to why Khan was not included on the panel.
Khumalo asks why it is IDAC's business who should be on the panel. Padayachee says they are charged with the investigation.
He says the panel is not chosen by anybody else...Padayachee says LT General Khumalo chose the particular panel and there were other crime intelligence generals who could've been chosen.
Khumalo questions IDAC's involvement, even assuming panel approval, and challenges their pursuit of warrants through legal channels.
He asks why this falls within the panel's purview. Baloyi supports Khumalo's stance, questioning IDAC's jurisdiction given that the panel was established by senior SAPS management. Padayachee states that an inference was drawn from the recommendations. Baloyi then interjects, inquiring about the nature of this inference, asserting that it falls under SAPS's jurisdiction, not IDAC's.
Baloyi criticizes IDAC for exceeding its authority by creating its own regulations and questions its legitimate involvement and interest in establishing South African Police Service (SAPS) panels.
The commission was dealing with General Khan's affidavit speaking about the post. Commissioner Khumalo says even then, lawyers and people from other professions could apply. Khumalo says the requirements were not made to favour Mokwele.
In 2023, Khan was a member of the panel.
The commission asks Padayachee if it was proper to take a file relating to Brigadier Dineo Mokwele’s appointment to Khan. Padayachee says that he noted it but did not see it at that time when he was interviewing Khan. Sello says it's highly improper. Sello says he was influencing Khan’s statement for the criminal investigation.

The affidavit in question, and the allegations that Ncube and Mokwele got together and did something wrong, is being scrutinised by the commission.
@newslivesa How is Gen Khumalo involved in a cover up when this issue of Gen Lushaba allegedly being robbed happened in (Feb 2022) way before Khumalo was appointed intelligence head in (Dec 2022) 🤷🏻♂️

Can we have a Madlanga Commission-style inquiry with the current panel, where the heads of every government department are required to account for the performance and state of their departments? I’d be interested to see what such a process would reveal.
