The sham LGBT conversion therapy ban the UK Gov announced this week says conversion therapy will still be allowed if it is being done to help someone’s health. It’s an absolute joke. Apt reminder that the specific, narrow reason transphobes approve of this policy is that they view it as institutionalised corrective rape of an undesirable group. The filthy little cowards shiver with barely concealed glee thinking of sexual violence inflicted on the "deviants".
The European Court of Human Rights (ECtHR) recognises that transgender prison inmates are a highly vulnerable group requiring enhanced state protection.
Under the European Convention on Human Rights, particularly Article 8 (Right to respect for private and family life), the Court mandates that prison authorities provide access to gender-affirming healthcare, including hormone replacement therapy (HRT).
Court's legal framework and the broader Council of Europe standards regarding transgender inmates are built around several key principles:
1. Access to Gender-Affirming Healthcare.
In the landmark case of W.W. v. Poland, the ECtHR ruled that denying a transgender inmate access to medically prescribed hormone therapy violates Article 8.
The Court determined that self-determination and gender identity are essential aspects of private life, and states place a disproportionate burden on inmates by requiring them to undergo additional, unnecessary medical consultations to prove the necessity of life-improving or life-saving treatment.
2. Prison Accommodation and Placement.
Placement of transgender prisoners remains one of the most complex issues within European penal systems. The European Committee for the Prevention of Torture (CPT), which operates alongside the ECtHR, enforces standards stipulating that:
•Transgender individuals should generally be accommodated in the prison section corresponding to their gender identity.
•Isolation or segregation should remain strictly exceptional, short-term, and only used for the inmate's protection.
•Inmates must be allowed to express their gender identity through access to appropriate clothing, cosmetics, and hygiene products.
3. Safety and Anti-Violence Safeguards.
The ECtHR and the CPT mandate that national prison authorities actively prevent ill-treatment, intimidation, and inter-prison violence targeting transgender individuals. Because transgender inmates are frequently exposed to high risks of abuse from both staff and other prisoners, authorities are required to train prison staff appropriately and enforce strict anti-discrimination policies.
Body searches must also be conducted in a manner that respects the individual's dignity and does not cause psychological harm.
