The double standard for husbands and wives in India (Part 1)

Marriage falls apart. Wife moves out.
She seeks interim maintenance under:

1. Domestic Violence Act
2. Section 125 CrPC
3. Applicable divorce law

Interim maintenance is fixed on the basis of income, assets, expenses and liabilities of the parties.

As a legal strategy, both sides conceal their incomes.

To prevent this, the Supreme Court in 2020 in the judgment of Rajnesh Versus Neha, mandated the filing of Income Affidavit by both parties.

Even after the judgment, as a legal strategy, both sides try their best to delay filing of the Income Affidavit for as long as possible.

Now here is the double standard.

If the wife doesn't file her Income Affidavit, her case is not dismissed.
The court is happy to presume that she is not lying about her being completely broke. The court is happy to proceed to arguments on interim maintenance.

On the other hand, if the husband does not file his Income Affidavit on time, the court says that it has no other option but to believe the hyper inflated figures of husband's earnings.
The court then fixes atrociously large sums of interim maintenance.

Appellate courts are also reluctant in reducing the amount.
"Why should we interfere? It is the husband's duty to beg, borrow or steal to provide for his wife"

I've seen husbands who actually earn Rs. 50,000 per month, being directed to pay to the wife Rs. 50,000 per month!
The entirety of his salary, sometimes even more, to the wife.

What can a husband do to tackle this?

4 steps:

1. File application seeking court orders directing the wife to file her Income Affidavit.
2. When she does file an incomplete Income Affidavit, without the mandatory accompanying bank statements and ITR, file an application seeking court orders directing her to file all the documents.
3. When she does file these documents, move Application under Section 340 CrPC for punishment of the Wife for perjury.
Even when you file this Application, most times the court will say we will decide this application at a later stage (that later stage never really comes). Therefore you must also-
4. File Application for disposal of the Application under Section 340 CrPC before Interim Maintenance is decided.
