@icydeadpeeps@NatetheLawyer Many of our unenumerated rights are protected under the clause of the 14th amendment and aren't traditional (i.e women's votes). Please clarify, as it sounds like your saying "yes, it has to be traditional so you're wrong about it having to be traditional."
@NatetheLawyer Basically they are leaving it up to the states on whether or not to keep or take away a right that we thought was federally protected. What other rights that are not tradition will be in jeopardy?
@NatetheLawyer We have held that the “established method of substantive-due-process analysis” requires that an unenumerated right be “‘deeply rooted in this Nation’s history and tradition’” before it can be recognized as a component of the “liberty” protected in the Due Process Clause.
@NatetheLawyer That was part of the Supreme Courts decision on why abortion should not be federally protected. They based their decision in part because it was not traditional. I believe they have set a dangerous precedent. There's a lot of rights that we have that are not tradition.
