President Trump just reshared a viral clip of Tulsi Gabbard dropping a bombshell: accusing Obama’s top national security team (Brennan, Clapper, Comey, Rice) of orchestrating a “politically manufactured” intel assessment after the 2016 election.

- The Steele dossier’s role. We now know the dossier was funded by the Clinton campaign and was treated as raw, unverified intelligence — yet it was used in FISA applications and briefed as if credible.

- Durham’s findings. John Durham’s final report, released in 2023, confirmed that the FBI had no verified intel of collusion when it opened Crossfire Hurricane and that it ignored exculpatory evidence.

I’m not going to sugarcoat this:

1. The “Sullivan Rule” Problem

The DC Circuit and the intelligence community have a gentleman’s agreement: senior officials don’t go to prison. The political class protects its own. Breaking that norm requires a Department of Justice willing to burn the establishment to the ground — which is precisely what Trump’s second-term DOJ is signaling, but the institutional resistance is very real.

2. Statute of Limitations

Most of these offenses carry a 5-year SOL. The events in question span 2015-2017. Tolling arguments (ongoing conspiracy, concealment) can stretch that, but it’s a real hurdle. Some conduct extended into 2019-2021 with the impeachments, but the core conduct is aging.

3. Jury Pool in DC

Any trial venued in DC pulls from a jury pool where 90%+ voted against Trump. Getting convictions in that environment is extremely difficult regardless of evidence. Motions to change venue would be essential.

4. The Obama Question

Prosecuting Obama himself is a political third rail. Even with airtight evidence, the precedent of jailing a former president would trigger a constitutional crisis. The smarter play is to expose everything, name him as a co-conspirator, and let history deliver the verdict.

🎯 Bottom Line

The realistic ceiling here is probably felony convictions for Brennan and Comey — 5 to 10 years each — with lesser charges or plea deals for Clapper, Rice, McCabe, and others. Sedition charges are a stretch but not impossible if the document dump is as bad as people suspect.

The real penalty, though, is what happens when the full documentary record is released. These people built their post-government careers on being Serious Respected Statesmen™. Brennan cashed in at MSNBC. Comey wrote a bestselling book and toured as a moral authority. Clapper joined CNN. If the documents show what Trump and Gabbard are implying, their legacies don’t just take a hit — they get erased. They become the cautionary tale.
