On June 30, the U.S. Supreme Court issued a new ruling siding with Lorie Smith, a Christian web designer in Colorado who refused to create wedding websites for LGBTQIA+ couples due to religious objections.
Every conservative on the court ruled in favor of the web designer, with the 3 liberal justices dissenting.
In a 6-3 opinion penned by Justice Neil Gorsuch, SCOTUS found that the First Amendment bars the state of Colorado from 'forcing a website designer to create expressive designs speaking messages with which the designer disagrees.'
'As surely as Ms. Smith seeks to engage in protected First Amendment speech,' Gorsuch continued, 'Colorado seeks to compel speech Ms. Smith does not wish to provide.'
'Today, the Court, for the first time in its history, grants a business open to the public a constitutional right to refuse to serve members of a protected class,' Justice Sonia Sotomayor wrote in a dissenting opinion.
In its effect, this decision will likely dilute legal protections for LGBTQIA+ people in the U.S. It also ends a string of high-profile SCOTUS victories for LGBTQIA+ rights in recent years, such as 2013's United States v. Windsor and 2015โs Obergefell v. Hodges โ in yet another sign the courtโs current composition is more ideologically right-wing than ever before.
For months prior to the decision being issued, progressives criticized SCOTUS for taking this case in the first place. 'Please recall that no same-sex couple has ever sought to engage Lorie Smith's business to create a wedding for their website,' Slateโs Supreme Court expert Mark Joseph Stern tweeted this morning. 'This case is built entirely on hypotheticals; there are essentially no facts. The decision's scope is ambiguous and uncertain.'
