The Supreme Court just held that a U.S. President “may not be prosecuted for exercising his core constitutional powers, and he is entitled, at a minimum, to a presumptive immunity from prosecution for all his official acts.” It’s a decision that would make our Founders proud.
Alexander Hamilton understood the importance of an "energetic executive" (Federalist 70). It's why we elect one president instead of two consuls or a three-person directorate. It's also why the president must be able to exercise his "competent powers" boldly and with confidence.
Trump's lawyer John Sauer warned in oral arguments that allowing Presidents to be prosecuted for official acts would "destroy presidential decisionmaking." Presidents would have to walk on eggshells for 4-8 years & hope the next administration shows mercy.
Justice Thomas got it right: "there has been much discussion about ensuring that a President 'is not above the law.' But, as the Court explains, the President's immunity from prosecution for his official acts *is* the law."
The Court left some room for questions about what exactly counts as an “official act,” but no matter how you look at it, this is a major setback for the Biden DOJ’s lawfare campaign. Jack Smith should drop his politically motivated prosecution, so we can return to the country our Founders envisioned - one where the *voters* get to pick the President & hold him accountable, not prosecutors or litigants.

You can tell that her comment had an impact from the long and awkward pause that followed.
